Burkina : Le nouveau Code pénal proscrit les funérailles pour les condamnés à mort exécutés, la polyandrie désormais interdite
In Burkina Faso, the People's Legislative Assembly (ALP) adopted the draft Penal Code during its plenary session yesterday, Tuesday, October 20. This new text comprises nine books, 33 titles, and 97 chapters, for a total of more than 900 articles.
One of its main innovations is the re-establishment of the death penalty for certain offences such as terrorism, high treason, the murder of one of one's parents, espionage and the importation of expired or prohibited products which caused death.
"The death penalty is carried out by firing squad, lethal injection, hanging, or electrocution."
According to the Burkinabe website "Libreinfo", article 212-10 of the new Penal Code stipulates that "the death penalty shall be carried out by firing squad, lethal injection, hanging or electrocution, until death ensues, in a place designated by decision of the minister in charge of justice".
The execution may be made public. The method of execution is determined by a decision of the Minister of Justice. In the absence of such a decision, the execution is carried out by firing squad.
Article 212-12 also states that "execution cannot proceed before a decision has been made on the appeal for clemency and after all internal remedies have been exhausted."
No execution of pregnant women
Article 212-14 states that women sentenced to death cannot be executed if they are pregnant. They will only be put to death after giving birth.
Article 212-15 also provides that the body of the executed person shall be given to his or her family if the latter so requests.
However, all funeral ceremonies are prohibited, under penalty of imprisonment of one to five years and a fine of between 3 and 5 million CFA francs.
No polyandry in Burkina Faso
It should also be noted that the new Penal Code re-criminalizes press offenses and criminalizes homosexual and similar practices, the use of animals for sexual purposes, as well as polyandry (the fact of a woman being married simultaneously to several husbands).
