Le Burkina Faso, le Mali et le Niger quitteront effectivement la Cour pénale internationale en juin 2027 (officiel)
The Sahelian military regimes of Burkina Faso, Mali and Niger will effectively leave the International Criminal Court (ICC) in June 2027, one year after officially submitting their request for withdrawal, according to UN documents consulted Thursday by AFP.
These three countries, governed by juntas that claim a sovereignist policy and have turned their backs on the West, had jointly announced in September 2025 their withdrawal from the ICC, describing it as "an instrument of neo-colonial repression in the hands of imperialism".
On June 18, Niger officially filed its request for withdrawal, followed by its two neighbors six days later, according to notifications from the UN Secretary-General, who is the depositary of the Rome Statute that created the ICC.
In these notifications, Mali considers that "the distribution of fair international criminal justice, essential to the realization of the legitimate aspirations that motivated the creation of the ICC, is regularly hampered by the instrumentalization of the Court for political purposes."
Burkina Faso, for its part, believes that "over time, the Court has gradually moved away from its founding ideals, becoming a selective and politicized tool, to the detriment of the impartiality and objectivity that should characterize it."
Finally, Niger refers to the "misuse of the objective" and "instrumentalization of this jurisdiction".
Their release will take effect one year after this official notification.
The ICC stated that it had "taken note of the situation with concern" and regretted these withdrawals.
This decision "threatens to deprive thousands of victims of the opportunity to obtain truth, justice and reparations," lamented Marceau Sivieude, Amnesty International's director for West and Central Africa.
"Withdrawing from the ICC amounts to these governments hastily shirking their obligations under international law and justice," he added, arguing that this "will further entrench impunity."
Founded in 2002, the International Criminal Court's mission is to prosecute the perpetrators of the most serious crimes committed in the world, when countries do not have the will or the capacity to do so themselves.
The institution previously had 125 members. The United States and Russia are not among them, nor are Israel, China, or Burma.
She regularly faces criticism, particularly in African countries where she is accused of predominantly prosecuting figures from the continent.
The three Sahelian countries that are withdrawing are facing deadly violence from jihadist groups linked to Al-Qaeda and the Islamic State organization, but their armies are also accused of crimes against civilians.
