Invited to the "Objection" program on Sud FM radio, the president of the consumer organization SOS Consommateurs, Mr. Massokhna Kane, spoke out about a new contractual relationship in the making between Senelec and the company Akilee. Faced with the imminent signing of a new agreement, the lawyer and consumer rights advocate was categorical, threatening legal action and bringing the matter before parliament to shed light on the issue.
“If the Senelec board of directors—which is scheduled to meet next Friday—authorizes the CEO to sign a new contract with Akilee, we will file a complaint. We will also petition the National Assembly's energy committee to launch a public inquiry,” warned the head of SOS Consumers. Mr. Kane believes that, in addition to duplicating an agreement already signed (two years ago) with Amco for the supply of 300,000 meters, this new contract with Akilee, despite ongoing litigation, is both opaque and illegal for several reasons.
A flaw dating back to the 2016 Pan Yessal
To support his accusations, the former lawyer for Senegal went into detail about the history of this partnership, which he describes as problematic from its inception. "We developed the Yessal Plan in 2016. We decided that by 2020 we would buy electricity at between 60 and 80 CFA francs per kilowatt because we agreed that electricity in Senegal was among the most expensive in the world. The PMC firm participated in the design of this plan. Employees at this firm included Amadou Ly, Victor Ndiaye, and Blaise Diadiou," he recounts.
While the plan was being implemented, a group of PMC employees (Amadou Ly, Victor Ndiaye, and Blaise Diadiou) left the firm. In May 2017, Amadou Ly founded Akilee, following the creation of Alif by Ly and his associates Victor Ndiaye and Samba Laobé Ndiaye.
In the distribution of Akilee SA's capital, Senelec obtained 34% of the shares in exchange for a cash contribution of 300 million FCFA. The remaining 66% went to the private founders (Amadou Ly and the company Alif) on the "illegal" basis, according to the lawyer, of an in-kind contribution consisting of SIA software valued at 582 million FCFA.
According to Mr. Massokhna Kane, citing the 2023 OFNAC report and the ARMP report, "the contract between Senelec and Akilee violated numerous regulations," particularly the public procurement code. "They tried to classify it as a partnership agreement, which it wasn't. They referred to Akilee as a subsidiary of Senelec, which wasn't true. What was completely abnormal was committing Senelec to a 10-year contract for 2.7 million meters, whereas for 50,000 meters, Senelec should have followed the public procurement code and issued a call for tenders. Here, Senelec directly ordered 2.7 million meters from Akilee over 10 years for 186 billion CFA francs. This is completely illegal, the ARMP concluded," he insists.
OFNAC, for its part, identified eight offenses in this "illegal agreement," including embezzlement of public funds and fraud; the investigation is ongoing. Consequently, as Mr. Kane points out, denouncing the situation: "It is under these circumstances that they want to force Senelec and Akilee to sign a new contract."
A new protocol that is dangerous for the state and consumers
According to the head of SOS Consommateurs, Akilee and Senelec are attempting to reach an agreement in complete secrecy. "The settlement agreement that will be submitted to the board of directors, which supposedly puts an end to all the litigation between Akilee and Senelec, is very dangerous," warns the lawyer, who reveals that the terms of this new contract are more closely guarded than the nuclear briefcase code. Just days before the crucial board meeting, no one has any information about the contract's clauses, he maintains.
"Why sign a new contract with a partner with whom we are in dispute? How can we allow Akilee to supply meters when there is already a 15-year contract with Amco for the supply of 300,000 meters per year covering Senelec's annual needs?" he asks.
