«À cette cascade de non-lieu... » : un ancien magistrat annonce une bonne nouvelle pour Pape Cheikh Diallo et Cie
Analyzing the release of 28 defendants in the so-called "Pape Cheikh Diallo and Co." case, retired magistrate Ousmane Kane argues in L'Observateur that the case presents serious legal weaknesses. Judging that "some thirty dismissals [...] is too many in an investigation," the former magistrate specifically questions the legality of the collection of certain evidence, denouncing "a legally dubious use of the phones of the accused."
The expert points out that the prosecutions must be assessed in light of the previous legislation, which criminalized the commission of "acts against nature." He believes it will be necessary to establish that such acts were committed individually by each defendant and that the mere content of the messages will not be sufficient to establish their criminal guilt.
The interviewee for the Groupe Futurs Médias newspaper warns that "this cascade of dismissals before the investigating judge is likely to be followed by another cascade of acquittals before the court," anticipating further difficulties for the prosecution during the hearings, especially if the defense manages to effectively challenge the legality and solidity of the evidence.
