The prosecution is contesting the verdict handed down on October 20th by the First Criminal Chamber of Dakar, which acquitted the defendants in the case of the alleged fuel theft from EDK Oil SA and SENSTOCK. According to Seneweb, the public prosecutor at the Dakar High Court filed an appeal today against the judgment in the case opposing the prosecution and EDK to Malamine Thiam, Assane Mbaye, Babacar Diop, Bassirou Fall, Bakhao Diol, and others.
The defendants were prosecuted for conspiracy, theft committed by an organized group using a company vehicle while on duty, receiving stolen goods, and complicity. The case concerns an alleged fuel theft estimated at over 2 billion FCFA. The EDK company had claimed 5 billion FCFA in damages.
In his closing arguments, the public prosecutor had requested five years' imprisonment for all the defendants. However, in delivering its verdict, the court did not follow the prosecution's recommendation. The presiding judge acquitted all the defendants.
The prosecution's appeal does not keep Malamine Thiam and others in prison. They are free pending their trial before the Dakar Court of Appeal.
