Bras de fer entre Aziz Ndiaye et Awa Baldé : La Justice a tranché !
The legal battle between Awa Baldé and businessman Aziz Ndiaye has reached its conclusion in the first instance. On July 23, 2026, the Dakar Criminal Court issued its verdict in the case concerning the disputed sale of a plot of land exceeding 7,000 square meters in Ngaparou, ruling that the statute of limitations had expired. This decision thus brings the criminal proceedings to a close.
The case dates back to 2018, but Awa Baldé only filed a complaint in December 2025.
She claimed to have entered into an agreement with Aziz Ndiaye for an amount exceeding 125 million FCFA, including the delivery of a turnkey villa. According to her statements, she had agreed to the sale deed mentioning a price of 50 million FCFA at the businessman's request, who, she said, wanted to reduce the costs associated with the transaction.
The plaintiff claims to have ultimately received only about 37 million FCFA, without ever receiving the promised villa. Convinced she had been swindled, she filed a complaint against Aziz Ndiaye and Élimane Lam.
However, following an investigation by the Criminal Investigation Division (DIC), the case was dismissed by the Financial Judicial Pool. Determined to pursue the matter, Awa Baldé then filed a direct summons with the criminal court.
In court, Aziz Ndiaye categorically rejected the accusations. The administrator of Aziz Business Company (ABC) maintained that it was Awa Baldé herself who had offered to sell him the land. "She finally agreed to sell me the land for 50 million FCFA," he stated, specifying that he had paid the entire sum and covered all the transfer fees.
The businessman also explained that the land belonged to the plaintiff's ex-husband and that she only had power of attorney to carry out the transaction. According to him, the property, acquired a few years earlier for approximately 11 million FCFA, was then just a simple field with a chicken coop. "I only heard about the 120 million FCFA when she filed a complaint against me with the Financial Judicial Pool," he stated, denying any promise of a villa or any agreement regarding a 125 million FCFA transaction.
Aziz Ndiaye's legal counsel, Souleymane Soumaré, Arona Bass, and Moussa Konaté, argued that the dispute fell exclusively under civil law and not constituted a criminal offense. They produced several releases signed by Awa Baldé, as well as the official sales agreement setting the price at 50 million FCFA, demonstrating that their client had fulfilled all of his contractual obligations.
The lawyers also raised the statute of limitations exception, recalling that the events dated back to 2018, while the summons was only introduced in 2025.
Accepting this argument, the Dakar criminal court ruled that the public action was time-barred, definitively extinguishing the criminal proceedings against the businessman.
