Chambre criminelle : 10 ans de réclusion réclamés contre un transporteur accusé d'avoir violé sa receveuse à Malibu Plage
The case shook the transport sector in the Dakar suburbs in 2023. The trial of A. Diouf (44 years old), a transport worker residing in Yeumbeul, was held this Thursday, July 23, 2026, before the Criminal Court of Pikine-Guédiawaye. Placed in pretrial detention on August 4, 2023, he is accused of rape by his former bus conductor, M. Barry, who is of legal age. Although the accused denied the charges, the public prosecutor requested a 10-year prison sentence, while the defense pleaded for outright acquittal.
During the court proceedings, the accused maintained his defense by denying the rape. As during the investigation, he attempted to convince the court of the existence of a secret romantic relationship with the complainant.
A version firmly rejected by the victim. In court, Mr. Barry, who had previously withdrawn his civil suit, maintained his accusations, categorically denying any romantic relationship with his employer. According to the victim's account, the events date back to August 2023. The plaintiff was then working as a bus conductor for the accused. However, following a traffic incident involving another driver, she was given an unjustified suspension from work by her employer.
According to her account, the garage manager then attempted mediation, suggesting she contact A. Diouf to resolve the dispute. Diouf arranged a meeting before driving her, on his motorcycle, to a guesthouse in Malibu Beach. It was there, in the privacy of a room rented for two hours, that the trap was allegedly sprung. When the woman refused, the driver forced her onto the bed, threatening her with death and physical abuse using a can of soda, before sexually penetrating her despite her screams and tears.
Called as a witness, the hostel manager stated that he heard screams coming from the room. He also claimed to have seen the victim come down the stairs crying, telling him that she had been raped.
When confronted by the manager, the driver initially admitted to the act, claiming his partner had consented, before giving her 5,000 FCFA for her transportation costs. Meanwhile, a medical examination conducted by King Baudouin Hospital revealed an old hymenal tear.
A. Diouf firmly denied the rape allegations. While he admitted to going to the inn with his employee, he maintained that they were having a secret romantic relationship. He mentioned consensual oral sex, but asserted that the young woman refused penile intercourse.
Lacking legal counsel, the plaintiff did not claim damages. However, she stated that she had received 150,000 FCFA from the accused's family.
In his observations, the public prosecutor was not convinced by the theory of a romantic relationship. Believing that the elements of rape were clearly established in this case, particularly in light of the threats and the context of professional subordination, the prosecutor requested a severe sentence of 10 years' imprisonment for the transport company driver.
The defense, comprised of lawyers Abdoulaye Tall, Mame Coumba Kane, Khady Sèye, and Pape Mor Niang, took the opposite stance to the prosecution. Denouncing the lack of irrefutable physical evidence and relying on their client's denials, A. Diouf's lawyers argued for a complete acquittal.
The lawyers remain convinced that their client was in a relationship with the woman. According to Mr. Tall, the plaintiff was simply trying to "make some money." He revealed that at the beginning of the case, she had demanded 500,000 FCFA, only to ultimately receive 150,000 FCFA.
The case was adjourned for deliberation until August 4, 2026.
