Code de la famille, cadis et égalité devant la loi : Dar Al Istiqaamah expose ses préoccupations au ministre de la Justice
The Minister of Justice, Keeper of the Seals, Moussa Sarr, received a delegation from Dar Al Istiqaamah on Thursday, August 6th. The delegation presented him with several concerns, including those related to the Family Code, the presence of qadis (Islamic judges) in the courts, and respect for the principle of equality before the law. Following the discussions, the Minister pledged to examine the various grievances but did not announce any immediate measures.
Led by Dr. Cheikh Mohamed Ahmad Lo, the delegation welcomed the first initiatives undertaken by the new minister, believing that they reflect a desire to strengthen the effectiveness of the public justice service.
At the heart of the discussions was the Family Code. Dar Al Istiqaamah believes that certain provisions, particularly those relating to divorce and inheritance, are no longer aligned with the sociological, cultural, and religious realities of Senegal. The organization therefore advocated for a revision of these provisions to better harmonize current law with national specificities.
The issue of qadis was also raised. Organization officials expressed regret over their limited presence in several lower courts and the shortcomings observed in their training. They proposed increasing their deployment within the relevant jurisdictions.
Furthermore, the delegation expressed its concerns regarding what it considers to be discriminatory treatment in certain proceedings involving members of Dar Al Istiqaamah. According to its representatives, this perception of inequality before the law could fuel tensions and warrants particular attention.
In response, Mr. Moussa Sarr assured the court that he had taken careful note of all the concerns. He indicated that he would examine the possibility of assigning qadis (judges) to courts that currently lack them. Regarding the allegations of unequal treatment, the Minister of Justice reiterated that all citizens are equal before the law and reaffirmed his commitment to ensuring respect for this fundamental principle.
