Détention provisoire : Le ministre de la Justice reconnaît des mandats de dépôt parfois non nécessaires
Pre-trial detention is at the heart of the concerns of the NGO 3D. Received this Thursday by the Minister of Justice, Keeper of the Seals, Me Moussa Sarr, a delegation led by its president Moundiaye Cissé alerted to several major issues related to the functioning of the judicial institution, in particular the use of committal warrants, the "returns from the prosecutor's office", the effective absence of a judge of freedoms and detention, as well as the deterioration of prison conditions.
On the issue of detention, the minister acknowledged that unnecessary arrest warrants are sometimes issued by the public prosecutor's office. He indicated that a circular has been issued to remind magistrates of the need to rationalize the use of these warrants, which are too often issued almost systematically.
The NGO 3D also advocated for better oversight of detention during criminal investigations and for the effective establishment of a judge responsible for pre-trial detention. Furthermore, the organization denounced the degrading conditions prevailing in some prisons, as well as the lack of human resources, both within the judiciary and the legal profession.
Another major concern raised is access to justice for impoverished people. The NGO wants legal aid to be expanded to cover more needs, particularly in civil and family matters such as divorces and inheritance proceedings.
In response to these requests, Mr. Moussa Sarr assured that several of these reforms are already incorporated into the draft revision of the Code of Criminal Procedure, which is currently going through the administrative process. He also announced the launch of a review of the leaks of police reports to the press, with the aim of better guaranteeing the confidentiality of investigations and preliminary inquiries.
The Minister of Justice finally emphasized the imperative of placing the citizen at the center of the judicial system. "We must change the paradigm," he stated, calling for better consideration of the "demanding and legitimate" expectations of those seeking justice.
