[Exclusif] Retardataires de la déclaration de patrimoine : La mise en demeure ferme du ministre de la Justice
In a circular letter dated August 5, 2026, the Minister of Justice, Keeper of the Seals, Moussa Sarr, issued a formal notice to senior state officials and those subject to the requirement who have yet to comply with the legal obligation to declare their assets. The document is addressed directly to the directors general, the directors of the central administration of the Ministry of Justice, as well as the presiding judges and chief prosecutors of the courts of appeal.
The Minister of Justice emphasizes that Law No. 2025-13 of September 3, 2025, and its implementing decree No. 2025-1835 of November 18, 2025, established "a strengthened system for preventing and combating illicit enrichment, based on the principles of transparency, integrity, and good governance." In this regard, the Minister stresses that this obligation applies "upon assuming office, during the performance of duties in the cases provided for by law, and upon leaving office."
However, the report drawn up by the Ministry of Justice reveals persistent shortcomings. The Minister notes that it has been observed that "some taxpayers have not yet fulfilled this legal obligation or have not updated their declarations when required." Faced with this situation, Moussa Sarr formally urges those who are late to "take the necessary steps as soon as possible with the relevant departments of the National Anti-Corruption Office (OFNAC), in accordance with established procedures."
The Minister of Justice concludes his circular by warning offenders of the consequences of their inaction. He firmly reiterates that "failure to comply with the obligations relating to the declaration of assets may lead to the consequences and sanctions provided for by the legislative and regulatory provisions in force," while calling on all stakeholders to "ensure full and complete compliance with the requirements of the regulations."
