War at Abys Garden: accounts placed under sequestration following Babacar Athie's complaint against Aby Ndour

The conflict between the two partners of Abys Garden, a Dakar-based company specializing in event planning and catering, has taken a new legal turn. The judicial investigation, opened in November 2025, initially targeted Babacar Athie for alleged "misuse of company assets." However, according to Libération, the case took a new turn on May 22nd when he filed a civil suit against his partner, Aby Ndour.

The daily newspaper reports that Babacar Athie accuses Aby Ndour of withdrawing 40 million CFA francs from a company bank account and failing to remit over 242 million CFA francs in revenue, including proceeds from a concert held at the Dakar Arena in January. For his part, Aby Ndour accuses his partner of misappropriating funds from an internal fund and selling off company equipment. The two cases were ultimately consolidated, leading to Aby Ndour's indictment and placement under judicial supervision for "misuse of company assets" and "obstructing the freedom to work." The two founders thus find themselves simultaneously plaintiffs and defendants.

In light of an accounting audit that revealed management irregularities attributable to both parties, while noting that the company was continuing its operations normally, the investigating judge decided to place Abys Garden's financial flows under the supervision of a court-appointed receiver, Libération reports. This independent third party, sworn in before the magistrate, is responsible for monitoring bank transactions, ensuring the transfer of revenue, and paying salaries, suppliers, and expenses, while reporting monthly to the judge. However, the receiver does not intervene in the company's day-to-day management or in resolving the dispute between the partners, the same source explains.
