Licenciement de 19 élèves policiers : La Cour suprême ordonne la suspension de la décision
Last Monday, the Supreme Court ordered the suspension of the execution of the decision to dismiss several trainee national police officers who had passed the professional examination. The case was argued before the judge of summary proceedings in the administrative chamber.
The Supreme Court, seized by Katy Camara and several other police trainees represented by lawyers Assane Dioma Ndiaye and Idrissa Cissé, ruled on their application for interim relief against decision no. 011667 of May 22, 2026, issued by the Minister of the Interior and Public Security. This decision had dismissed them for unauthorized absence and failure to comply with internal regulations.
The applicants argue that their immediate and permanent dismissal causes them serious harm. In their application, registered with the Supreme Court on August 18, 2026, under case number 408, they also requested the annulment of the ministerial decision. The Ministry's interests were represented by the State Legal Agent.
In issuing his order, the judge in chambers recalls that the suspension of an administrative decision is subject to two cumulative conditions: urgency and the existence of a means capable of creating serious doubt as to the legality of the contested decision.
Regarding the urgency, the court considers that the dismissal is likely to lead to a definitive break in the applicants' careers as well as their deprivation of professional status and remuneration for the duration of the proceedings on the merits.
In this case, the court emphasizes that the arguments raised are such as to create serious doubt as to the legality of the ministerial decision. It notes in particular that the dismissal was applied to trainee officers who had passed the professional examination without any formalities, either as a disciplinary measure or for insufficient results, whereas Article 12 of Law No. 2009-18 of March 9, 2009, concerning the status of National Police personnel, provides for the sanction of losing eligibility for appointment within the force for these officers.
The high court also refers to article 40 of decree no. 2009-490 of May 28, 2009, which provides for their immediate reinstatement in their original administration.
Ultimately, the judge of the summary proceedings of the administrative chamber of the Supreme Court ordered the suspension of the execution of decision no. 011667 of May 22, 2026 of the Minister of the Interior and Public Security concerning the dismissal of trainee agents of the national police.
