Mbour : Djibril Faye condamné à un an ferme et 80 millions FCFA d'amende dans l'affaire de la maison de Saly
The High Court of Mbour has ruled in the case between car dealer Djibril Faye and emigrant Moustapha Dieng, concerning a house located in Saly Carrefour Extension. Found guilty of forgery and use of forged documents, Djibril Faye was sentenced to two years in prison, one of which is a mandatory minimum sentence. An arrest warrant has also been issued for him. He will also have to pay the substantial sum of 80 million CFA francs to Moustapha Dieng in damages.
As a reminder, it all started with a loan of 10 million CFA francs requested in November 2024 by Moustapha Dieng, a Senegalese man living in Spain. After giving up on selling his house for 70 million CFA francs, he approached Djibril Faye to obtain financing, handing over his property documents as collateral.
According to his statements in court, the interest was initially set at 5 million CFA francs. But after two payment postponements, the amount claimed reportedly increased from 15 to 35 million CFA francs.
A version disputed by Djibril Faye, who claimed to have bought the house for 15 million CFA francs, of which 11 million were paid in cash and 4 million by check, according to a deed of sale dated November 26, 2024.
However, the investigation revealed several irregularities in the transaction, notably the absence of notarized authentication and details relating to the property. The testimonies gathered also supported the theory that the loan was secured by the house's documents.
During the debates, Me Élimane Amar Kane, lawyer for the civil party, denounced a maneuver intended to strip his client of his real estate assets.
“The usurer’s interest is not repayment. The usurer’s interest is to seize the collateral,” he insisted, finding it inconceivable that a house valued between 80 and 100 million CFA francs could be sold for only 15 million.
The lawyer had claimed 100 million CFA francs in damages.
The prosecution had also not spared the defendant.
“I didn’t think anyone could be so cynical towards someone who needed help.”
the prosecutor had launched, who had supported the theory of a usurious loan combined with forgery.
.
Despite the arguments of Me Oumar Sène, the defense lawyer, who had tried to have the existence of a genuine real estate transaction recognized, the court ultimately found Djibril Faye guilty of forgery and use of forged documents.
The vehicle seller did not appear when the verdict was delivered.
