« Ne pensez pas que vous pouvez emprunter de l’argent sans être inquiété » La juriste Mariama Gakou Faye apporte des précisions de taille sur la circulaire du ministre
In a firm circular dated July 10, 2026, the Minister of Justice, Keeper of the Seals, Moussa Sarr, called for an end to the use of the police and gendarmerie as debt collection agencies. He deplored the fact that too many cases related to simple debts still end up in the hands of investigative services, with coercive measures that leave those involved "no alternative but payment."
To remedy this, the minister ordered magistrates to return to the essentials. He asked them to prioritize alternative dispute resolution methods in cases with financial implications, to favor release whenever guarantees of appearance exist, and to dismiss complaints falling under civil or commercial law.
In the same vein, he urges the Attorneys General, Public Prosecutors and Presidents of the Courts to break with the reflex of the systematic arrest warrant.
The objective is twofold: these measures will help to relieve overcrowding in saturated prisons and bring the criminal justice response back to its proper place.
These directives immediately ignited public debate. On social media and in discussions, many Senegalese are worried. Many are wondering if the creditors aren't the biggest losers in this reform.
To dispel this misunderstanding, business lawyer and legal and administrative expert Mariama T. Gakou Faye offered clarification. No, she insists, the circular does not render the law meaningless. "Purely civil disputes, such as loans between individuals, remain under the jurisdiction of civil courts," she reiterates. The only exception: loans granted or guaranteed by the State, which fall under criminal law.
However, once the facts cross the line into criminal law, the door to prosecution remains wide open. Fraud, breach of trust, or any other criminal offense can still lead to prosecution and prison sentences as provided by law.
In short, concludes Mr. Gakou, this circular "does not absolve anyone of their responsibility." It simply imposes a requirement on judicial actors: to correctly classify the facts and rigorously apply the law. Neither impunity for offenders nor prison for those who act in good faith.
