Plus de 2,2 milliards FCFA en jeu : les dessous du contentieux entre l'Aser et Askia Assurances
Funded by the European Union to the tune of 5.59 billion CFA francs, the rural electrification project intended to bring 20,500 households in Kolda and Vélingara out of darkness has turned into a fiasco. L'Observateur reveals that a legal battle is now pitting the Senegalese Rural Electrification Agency (ASER) against Askia Assurances before the Dakar Commercial Court, with more than 2.2 billion CFA francs at stake.
According to information from the daily newspaper of the Future Media Group (GFM), the dispute stems from an initial advance of 1,741,892,694 FCFA paid in 2015 to the Enco-Isofoton/Morocco consortium. To protect public funds, a repayment guarantee was taken out with the insurer. However, faced with delays and the termination of the contract in April 2021, Aser activated this coverage. The newspaper specifies that despite repeated reminders and the intervention of the European Union, this "activated advance repayment guarantee" has "remained ineffective."
Faced with this impasse, Aser opted for a more forceful approach. Gfm reports that in June 2024, the Dakar Commercial Court authorized a "precautionary seizure" of Askia Assurances' bank accounts up to the principal amount. A few days later, a bailiff effectively froze the company's accounts.
The battle is now being fought on the merits. The same source indicates that Aser is demanding full payment of the €1.741 billion guarantee, as well as €500 million in damages for "abusive resistance," for a total of €2.24 billion. The public agency reiterates that this guarantee is an "independent commitment" binding on the insurer, while Askia Assurances will have to justify its refusal in court.
