Recours sur la réintégration de Sonko : le juge Cheikh Ndiaye n'a pas siégé !
The Constitutional Council issued its decision No. 5/C/26 on Wednesday concerning the appeal filed by opposition members of parliament against the reinstatement of Ousmane Sonko to the National Assembly.
The high court declared itself incompetent to examine the request concerning "the decision of May 24, 2026 by which the Bureau of the National Assembly proceeded to integrate Mr. Ousmane Sonko into this institution as a deputy".
Beyond the decision itself, the composition of the body that deliberated is noteworthy. According to the decision published by the Constitutional Council, five members participated in the session of June 17, 2026: Aminata Ly Ndiaye, acting vice-president, Youssoupha Diaw Mbodj, Awa Dièye, Cheikh Ahmed Tidiane Coulibaly, and Mouhamadou Bachirou Sèye.
Judge Cheikh Ndiaye was not among the members who sat during the examination of this case.
This absence comes amid speculation fueled in recent days on social media.
In a post on X last week, journalist and head of the Avenir Communication group, Madiambal Diagne, reported on a "highly confidential and strategic" meeting that allegedly took place between Ousmane Sonko and Judge Cheikh Ndiaye.
According to this publication, the Pastef leader visited the member of the Constitutional Council on Friday, June 5, 2026 for a one-on-one interview of about two hours, while the jurisdiction was seized of an appeal concerning the validity of his seat as a deputy.
"This tête-à-tête fuels suspicions, especially since the Constitutional Council is seized of the dispute over the validity of Sonko's seat as a member of parliament," Madiambal Diagne had notably written.
However, shortly after this publication, several voices challenged these claims, arguing that Judge Cheikh Ndiaye had been outside the national territory since June 2, i.e. before the date of the alleged meeting mentioned by Madiambal Diagne.
In inviting him, journalist Maimouna Ndour Faye also emphasized that she had learned from her sources that the judge had indeed travelled.
In its decision, the Constitutional Council recalls that the control of the legality of administrative acts falls within its jurisdiction only when they directly contribute to the regularity of a national election.
The judges believe that the contested decision, which came after the proclamation of the final results of the early legislative elections of November 17, 2024, is not directly related to the electoral process.
Consequently, the Constitutional Council declared itself incompetent to hear the appeal, thus confirming Ousmane Sonko's continued presence in the National Assembly.
