Recouvrement de dettes et privation de liberté : Ce qui change réellement avec la nouvelle circulaire du garde des Sceaux
The spokesperson for the Ministry of Justice, Magistrate Mouhamadou Ndiaye Sarr, provided significant clarification on the scope of the circular dated July 10, 2026. He emphasized that this directive is not an innovation in criminal policy, but rather a continuation of the guidelines already issued in 2019. The main objective of this document is to strengthen the monitoring of its implementation throughout the country. The real innovation lies in the evaluation mechanism put in place: the Minister of Justice will now meet monthly with the Attorneys General to review progress, assess results on the ground, and make any necessary adjustments.
Addressing the issue of pretrial detention, Mouhamadou Ndiaye Sarr reiterated the Ministry of Justice's policy that detention orders should remain an exceptional measure, reserved for cases of extreme necessity. Whenever possible, prosecutors are encouraged to prioritize legal alternatives, such as sentence adjustments, community service, suspended sentences, or electronic tagging, in order to alleviate overcrowding in prisons.
Regarding civil and commercial disputes, the spokesperson clarified that the circular in no way releases debtors from their financial obligations. Recalling that keeping one's word is a cornerstone of contractual relationships, the magistrate explained that the measure primarily aims to prevent judicial police officers from being used as pawns in private matters. Debt recovery must now be carried out exclusively through the enforcement procedures of civil law, excluding any recourse to imprisonment to compel a citizen to pay a debt.
Finally, the Ministry of Justice intends to tighten controls on detention conditions in police and gendarmerie stations. To this end, public prosecutors are required to conduct regular inspections of police stations and brigades. They will be required to speak directly with individuals in custody, carefully examine the reasons for and legal duration of detention, thereby guaranteeing the preservation of fundamental rights and strict adherence to the rule of law.
