Eighteen-year-old Mr. Guèye appeared before the Thiès court for flagrant offenses to answer charges of breach of trust. His cousin had entrusted him with a motorcycle so he could work in the transport sector and support himself. However, the young man ultimately sold the motorcycle.
In court, the defendant did not deny the facts. To justify his actions, he cited significant financial difficulties. According to his explanation, his partner, whom he had impregnated, required urgent medical care and prescriptions. Penniless, he claimed to have sold the motorcycle to cover these medical expenses, even though the vehicle had been loaned to him by a relative for professional purposes.
For the prosecution, these personal difficulties could not justify the sale of someone else's property. Considering the offense clearly established, the public prosecutor requested a one-year prison sentence for the defendant.
Ruling on the matter, the court ultimately found Mr. Guèye guilty and sentenced him to six months in prison.
