Tribunal de Thiès : Pris sur une moto volée au KM 50, il accuse l'alcool de l'avoir rendu confus
The Thiès court found P. Mbaye guilty of stealing a Jakarta motorcycle and sentenced him to two years in prison, with two months to be served. The theft occurred in a bar located at KM 50.
Charged with attempting to steal a Jakarta motorcycle, the defendant denied the accusations in court. He explained that he had gone to the bar to drink alcohol before asking his friend, Momo, to lend him his motorcycle to go to a shop.
According to his version of events, his friend gave him the keys to his motorcycle. Once in the parking lot, he claims he mistook the two motorcycles due to his intoxication. He then allegedly tried to leave with another Jakarta motorcycle before being stopped by the security guard, who immediately accused him of theft. The defendant insisted he had no intention of stealing the motorcycle, maintaining that alcohol was the cause of the mistake.
However, the investigation revealed that the motorcycle's safety bar had been broken before the defendant attempted to leave the scene with the vehicle.
Believing that the evidence in the case clearly established the facts of the theft, the public prosecutor requested a two-month prison sentence. Partially following this recommendation, the court found P. Mbaye guilty and sentenced him to two years in prison, with two months to be served.
