Pastef officials were quick to react. Indeed, during its session on October 15, the Constitutional Council ruled that the organic law adopted by the National Assembly on October 1, 2026, was "contrary to the Constitution".
Originally, it was a proposed law aimed at strengthening parliamentary oversight and the regulation of special appropriations or funds by amending the organic law of February 26, 2020, concerning finance laws (LOLF). However, after its adoption by the National Assembly, the President referred the matter to the Constitutional Council, which ruled in his favor.
“The President of the Republic is definitively burying the Jub Jubal Jubunti,” reacted MP Amadou Bâ, national secretary for Communication of Pastef.
In a text published on his digital platforms, he asserts that the Constitutional Council had "required the use of the organic law relating to finance laws (LOLF) to regulate special funds." The National Assembly complied, he maintains, "to prove the government's bad faith."
But, according to him, "to prevent the adoption of the framework for the special funds of the President of the Republic, the President of the Republic used his favorite weapon which the Constitutional Council interpreted to suit him: the blocked vote".
Amadou Bâ accuses the head of state of having proposed "sham" government amendments to thwart the vote of the deputies. He believes that the Constitutional Council "validated this dangerous strategy."
The Pastef official therefore believes that the Senegalese people now know that President Diomaye Faye "refuses to respect his oath of transparency in the use of special funds" and that "the National Assembly has fulfilled its mission".
Amadou Bâ believes that President Faye is only winning "Pyrrhic victories" through this decision, which, in his view, "are in reality real political defeats."
