Bras de fer Exécutif-Législatif ? Ousmane Sonko démonte la thèse du conflit autour de la révision constitutionnelle
In his first plenary session as President of the National Assembly, Ousmane Sonko sought to clarify the procedure surrounding the proposed law to revise the Constitution. Addressing questions raised by this parliamentary initiative, the former Prime Minister asserted that there is no institutional conflict with the President of the Republic, Bassirou Diomaye Faye. According to him, the Head of State was indeed consulted to provide his opinion on the text.
However, he clarified that this consultation is in no way an ultimatum. "The president is free to respond or not. His response is not obligatory, and in any case, the procedure will follow its course in accordance with the rules in force," he explained to the members of parliament. Ousmane Sonko reminded them that the Constitution provides two avenues for initiating a constitutional revision: the Executive or the Legislative branch. "The same Constitution that grants this right to the President of the Republic also grants it to the members of parliament," he emphasized, thus rejecting accusations that the Assembly was seeking to encroach upon the prerogatives of the Head of State.
The Speaker of the National Assembly detailed the various stages of the process. After the parliamentary initiative, the text must be examined in committee and then submitted to the plenary session. Once adopted by the members of parliament, it is sent to the President of the Republic for further processing. He also reiterated the required majority. Adoption of the text requires an absolute majority of members of parliament, while its approval requires a qualified majority of three-fifths. "We have not usurped any of the President's prerogatives. We are on the right track and in compliance with the Constitution," he emphasized.
Regarding the final phase, Ousmane Sonko indicated that the President of the Republic retains the option of submitting a text already passed by the National Assembly to a referendum. However, he clarified, the Head of State could not modify the content of the text adopted by the deputies. This clarification comes as the debate on constitutional reform continues to fuel discussions within the political class and among the public.
