“A law, however modern, is only effective if the State has the means to enforce it.” This is essentially the warning issued by members of parliament during the debates on the reform of the Labor Code. Faced with the rapid changes in the business world, the Labor Inspectorate is operating at a snail's pace, stifled by a critical lack of staff and logistical resources in the field.

According to the report presented in plenary session this Tuesday, the figures presented by the Minister of Public Service and Labor, Mamadou Lamine Dianté, paint an undeniable picture. Indeed, only 139 enforcement officers (58 inspectors and 81 controllers) are responsible for ensuring compliance with labor law throughout the entire country.

In the Dakar region, which is the country's economic and industrial heartland, oversight rests on the shoulders of just 32 agents (11 inspectors and 21 controllers). According to the Parliamentary Commission, this staff shortage makes regular monitoring virtually impossible, paving the way for abuses and repeated violations of workers' rights.

Dakar Region 32 agents (11 inspectors / 21 controllers)

Increased powers, but an urgent need for recruitment

To address this, the text significantly expands the scope of the inspectors' powers. Access to the heart of the digital infrastructure: Inspectors will be able to enter premises and also scrutinize management software, internal documents, and company data. Harsh sanctions: Direct formal notice (Article 367), immediate work stoppage in the event of serious danger to workers, and the possibility of imposing administrative fines without delay.

But the observation remains shared between the government and the deputies: these new legal weapons will remain a dead letter without a massive recruitment plan, better specialisation of agents by sector (construction, mining, digital) and a decent increase in their material and salary conditions.
