The government is defending the reform concerning asset declarations and the expansion of the obligation to publish them to the highest state authorities. Before the National Assembly, the Minister of Communication and Relations with Institutions, the government spokesperson, explained that this initiative aligns with President Bassirou Diomaye Faye's commitment to strengthening transparency and accountability. According to the government, the Head of State has decided to submit to a referendum the proposed law amending Article 37 of the Constitution. This decision was communicated to the President of the National Assembly by letter dated July 30, 2026. In this context, the government proposed an amendment to the Law Commission aimed at extending the obligation to publish asset declarations to the highest state authorities. The amendment was adopted by the Commission.
The President, the Prime Minister and the President of the Assembly concerned
The government believes that asset transparency should not be limited to the President of the Republic. It therefore proposes that the President of the National Assembly and the Prime Minister be subject to the same constitutional requirement. "The President of the Republic fully and completely supports the principle of a public asset declaration at the beginning and end of his term of office," stated the government spokesperson.
For the Executive branch, this obligation must be based on a principle of exemplary conduct applicable to the highest levels of government. The President of the Republic, the President of the National Assembly, and the Prime Minister must, according to the government, be held "under the same standard of exemplary conduct and integrity." The government points out that the President of the National Assembly and the Prime Minister are already subject to the asset declaration requirement under the legislation concerning the National Office for the Fight Against Fraud and Corruption (OFNAC). The proposed reform therefore aims to give this obligation a constitutional basis in order to make it more stable and less dependent on amendments to ordinary law.
The government responds to criticism of Article 37
The Executive branch also addressed criticisms that the amendment was inappropriate under Article 37 of the Constitution, which concerns the President of the Republic. The government maintains that this objection does not withstand legal scrutiny. It points out that the Senegalese Constitution already contains provisions relating to certain institutions in sections that do not directly reflect their status. Specifically, the government cites Article 68, which deals with the Court of Auditors in the section on relations between the executive and legislative branches, even though the Court of Auditors falls under the jurisdiction of the judiciary.
He therefore believes that no constitutional rule requires that each provision be exclusively linked to the title corresponding to the institution in question. According to the Executive, Article 37 even constitutes "the most appropriate natural forum" for addressing the declaration of assets, since it is the only constitutional provision dedicated to this matter.
A declaration of assets upon presidential candidacy
The government also wants to go further by including asset declarations in the presidential candidacy application. The President of the Republic wants a reform of the Constitution and the Electoral Code to require all presidential candidates to include an asset declaration in their application, under penalty of inadmissibility. According to the Executive branch, this provision would establish transparency even before the election. For the elected candidate, this declaration could then serve as their official declaration of assumption of office.
The government is thus defending a system aimed at avoiding the multiplication of reporting obligations, by linking transparency at the application stage with that required at the beginning and end of the exercise of functions.
Towards an obligation extended to other officials
The ambition expressed by the President of the Republic extends beyond the three main authorities of the State. The government indicates that Bassirou Diomaye Faye wants the requirement for transparency to be extended to all individuals covered by the law on asset declarations, or at the very least to the President of the National Assembly and the Prime Minister. The Executive presents this reform as a further step in building governance based on responsibility, integrity, and accountability. "The President of the Republic remains strongly committed to the principle of transparency," reiterated the government spokesperson, who welcomed the inclusion of this commitment in the amendment adopted by the Law Commission.
