Expiration du délai depuis vendredi : Ce que risquent désormais les autorités qui n’ont pas déclaré leur patrimoine
Taxpayers had until July 31, 2026 to file their asset declarations. As this deadline has now passed, authorities that have not complied with this obligation are subject to the penalties provided by law.
On July 3, the president of the National Office for the Fight against Fraud and Corruption (Ofnac) had in fact issued a warning.
"Upon expiry of this period, the persons concerned will be registered on the list of defaulting declarants which will be published, without prejudice to the criminal, administrative and pecuniary sanctions provided for in articles 5 and 16 of the aforementioned law," Moustapha Kâ had warned.
The fine, the prison sentence and the ban on practicing
Article 16 of the law, consulted by Seneweb, stipulates that failure to comply with the obligation to declare assets upon taking office or leaving office, after a formal notice from Ofnac has remained unheeded for one month, "is punishable by a prison sentence of six months to four years and a fine representing one-third of his last declared assets."
In addition to these sanctions, there is the possibility of imposing, as a supplementary penalty, a ban on holding public or elected office.
However, a party subject to this obligation who has not complied with it may escape sanctions if they can justify a case of force majeure recognized by law.
