MODIFICATION DU CODE MINIER : « LES DÉPUTÉS S’Y PRENNENT AVEC BEAUCOUP DE PASSION ET PEU DE MAÎTRISE », CONSTATE UN PORTE-PAROLE DE L’APR
Following the submission by several members of the Pastef parliamentary group of a bill aimed at amending the Mining Code, the spokesperson for the APR, Alioune Badara Coulibaly, believes that this initiative raises questions about the management of Senegal's mining, oil and gas resources.
"The MPs, members of the Pastef parliamentary group, Babacar Ndiaye, Ousmane Fall, Aminata Diaby, Safiétou Sow, Rokhy Ndiaye and Ababacar Tambédou have submitted bill no. 371206 amending law no. 2019-03 of February 1, 2019 relating to the Mining Code. As the law currently stands, the power to allocate oil, gas and mining rights rests exclusively with the Executive," he said.
According to him, debates surrounding extractive contracts are often marked by approximations and political communication that, in his view, could affect the confidence of partners and the attractiveness of the country.
Alioune Badara Coulibaly also recalls the tax reforms undertaken since 2012 under the old regime, in particular those aimed at strengthening transparency and better regulating operations related to mining titles and hydrocarbons.
The spokesperson for the APR party addressed the review of oil and mining contracts initiated under the government of Ousmane Sonko. He believes that the complexity of certain contracts, particularly those related to Sangomar, necessitates caution to avoid potential legal and economic risks for the state.
He also points out that when Ousmane Sonko was Prime Minister, "he established a special commission of experts to review oil and mining contracts. This seemed, however, like an admission of powerlessness, since major contracts like the one with Woodside for the Sangomar field and the one with BP proved difficult to break without risking international legal repercussions. Now that our country is fully immersed in the era of oil and gas production, managing communication surrounding contracts and investments has become a strategic imperative."
He explains that he is tempted to ask himself: "can the desire to catch a political opponent off guard and the ardent desire to confound him justify the use of certain malicious methods?
