Procès équitable : le Forum du justiciable saisit l'ONU sur le fonctionnement de la Haute Cour de Justice
The Forum of the Justiciable has sent a letter to the regional representative of the United Nations High Commissioner for Human Rights for West Africa, Robert Kotchani, based in Dakar. In this letter, its president, Babacar Ba, expresses concerns about the functioning of the High Court of Justice, before which former ministers are currently being tried.
For the Forum of the Justiciable, Law No. 2002-10 of February 22, 2002 relating to the High Court of Justice does not provide for any right of appeal, whether at the stage of the investigation or at the stage of the judgment.
“Articles 23 and 35 respectively state: ‘The decisions of the investigating commission are not subject to appeal; the judgments of the High Court are not subject to appeal or review by the Court of Cassation.’ By ruling in this way as a court of first and last instance, this jurisdiction deprives litigants of the possibility of appealing to a higher court. Such a procedural deficiency is contrary to the international commitments undertaken by the State of Senegal, in particular under the International Covenant on Civil and Political Rights and the African Charter on Human and Peoples’ Rights,” the text reads.
The organization also notes that the eight judges of the High Court are elected from among members of parliament and come from political parties. This composition, it argues, can "undermine the perception of the impartiality of the decisions rendered."
Babacar Ba and Co. are asking the UN institution to pay particular attention to this situation, with a view to formulating recommendations guaranteeing the rights of those prosecuted and the conformity of judicial practices to international standards.
