Réforme constitutionnelle : Babacar Gaye brandit la loi sur l'accès à l'information
Former Minister of State, former Member of Parliament and former President of the Kaffrine Regional Council, Babacar Gaye, has officially called on the Presidency of the Republic and the National Assembly to demand total transparency on the ongoing constitutional revision project.
In letters addressed to Oumar Samba Ba, Minister Secretary General of the Presidency of the Republic, and to the Secretary General of the National Assembly, consulted by Les Échos, he made a request based on Law No. 2025-15 relating to access to information, demanding "the full communication of the opinion transmitted by the President of the Republic" on the proposed law revising the Constitution.
According to Babacar Gaye, this opinion directly concerns "the exercise of national sovereignty and the functioning of the Republic's institutions." He maintains that it constitutes "an element of the legislative file" that contributed to informing the members of parliament and shaping their decision. In his view, it is also "a source of information that informs public opinion," particularly in the context of a potential referendum.
The former parliamentarian dismisses any notion of confidentiality, arguing that it is "neither a private document nor personal correspondence." He maintains that "none of the exceptions" provided for by the law on access to information justify its withholding. On the contrary, he believes that publishing this opinion would "strengthen the transparency of the constitutional process" and guarantee citizens complete information on the basis of the proposed reform.
The former Liberal official finally insists on the urgent nature of his request and recalls that the law provides for sanctions against any person who, "without legal basis", refuses to communicate public information or obstructs the exercise of the right of access to information.
