The president of the Pastef-Les Patriotes parliamentary group, Ayib Daffé, called on President Bassirou Diomaye Faye to promulgate the law amending Article 37 of the Constitution without appeal. Speaking to the press this Friday during a briefing on the National Assembly's extraordinary session, the MP also urged the opposition not to refer the matter to the Constitutional Council.
Returning to the proceedings of the extraordinary session convened since Monday, August 10, Ayib Daffé announced that several items are on the agenda, including three draft laws, three proposed laws, and proposed resolutions establishing parliamentary inquiry commissions. Regarding these inquiry commissions, the president of the Pastef parliamentary group sought to clarify any ambiguity. According to him, their establishment is not aimed at personally targeting any minister, head of an institution, or director general. " It is not about targeting any individual ," he explained, emphasizing the constitutional prerogatives granted to the National Assembly in matters of oversight of public action.
Article 37 is once again at the heart of the debates.
Ayib Daffé also spoke at length about the proposed constitutional law concerning asset declarations. An initial version had been adopted by the National Assembly before being rejected by the Constitutional Council, which had been petitioned by the Head of State. The Council had noted incompatibilities with certain constitutional provisions and requested a single, unified vote. MP Amadou Bâ then returned to the issue with a new proposal, this time aiming to amend Article 37 of the Constitution, which deals specifically with asset declarations.
For Ayib Daffé, this reform fulfills a political commitment made to the Senegalese people. The text is therefore among the items on the agenda for the extraordinary session. The government has also introduced an amendment concerning the requirement for the Prime Minister and the President of the National Assembly to declare their assets. Ayib Daffé clarified that this amendment was adopted in committee and that it is the amended text that will be submitted to the members of parliament for consideration in plenary session. On this point, the president of the Pastef parliamentary group believes that the Executive and Parliament are now " on the same page ."
"Let the president promulgate the law without appeal."
It was on the subsequent steps of the process that the MP was particularly assertive. Ayib Daffé directly called on the President of the Republic to promulgate the law once it was adopted, without referring it back to the Constitutional Council. He also appealed to the opposition, urging them not to file another appeal against the text. In his view, such a move would only further complicate the process surrounding a reform which, according to him, stems from a clearly stated political commitment.
Ayib Daffé finally rejected the idea that a single article of the Constitution could, on its own, justify holding a referendum. This was a way for the president of the Pastef parliamentary group to advocate for the parliamentary adoption of the reform and to dismiss the possibility of a new institutional battle over Article 37.
