Secret médical, garantir les soins, indépendance des soignants : Des députés réclament une « vraie médecine carcérale »
The examination of Bill No. 39/2026 concerning health in prisons is currently underway in the National Assembly during the third extraordinary session of 2026. At the meeting of the Intercommittee, comprised of the Committee on Health, Population, Social Affairs and National Solidarity and the Committee on Laws, Decentralization, Labor and Human Rights, held on Thursday, September 24, participants reported situations in which detainees are at risk of contracting serious or irreversible illnesses during their incarceration due to delays or inadequate medical care. They also noted that the current provisions regarding hygiene and healthcare in prisons remain relatively rudimentary, despite the regulations stipulated in Decree No. 2001-362 of May 4, 2001, concerning the procedures for the execution and adjustment of criminal sanctions.
In this regard, the commissioners stressed the need for the Ministry of Health and Public Hygiene to be effectively involved in implementing the system. They specifically addressed the training of medical staff working in prisons, their working conditions and remuneration, as well as the safeguards necessary to preserve their professional autonomy. They also recommended closer cooperation between health services and the prison administration, including the possibility that the attending physician for detainees could be assigned to the relevant health district or regional medical authority.
"Along the same lines, they stressed the importance of establishing a genuine organization of prison medicine, based on the accessibility, quality and continuity of medical care, as well as respect for medical confidentiality and the preservation of the professional independence of healthcare personnel," they stated in the report to the committee.
In this regard, it is reported that they cited situations that occurred a few years ago in which detainees requiring medical care were allegedly faced with the need to obtain authorization from the political authorities. According to them, such a practice was likely to infringe upon medical confidentiality and the independence of healthcare professionals.
Continuing, the commissioners argued for formalized collaboration between the ministries in charge of Justice and Health.
