Affaire Adax : Le mystère des 100 milliards de FCFA atterrit sur la table de la commission d'enquête
The Director of Large Businesses asserts that the Swiss company Adax is not listed in his department's active files, despite searches conducted. Before the parliamentary inquiry committee, members of parliament raised questions about a past tax procedure, discrepancies between the amounts mentioned, and the lack of actual tax recovery.
The Adax case continues to raise questions within the Senegalese tax administration. During a hearing before the parliamentary inquiry committee, Makhaly Faye, Director of Large Businesses (DGE), was questioned about the handling of a past tax case concerning this Swiss company, particularly regarding the traceability of the procedures initiated and the fate of the sums claimed. At the heart of the discussions was one question: how can it be explained that a case that resulted in tax assessments for considerable amounts now leaves so little trace in the files consulted by the relevant departments?
The lack of traceability in active files
Before the members of parliament, Makhaly Faye stated that, after conducting searches, the name Adax did not appear in either the physical directories or the databases currently used by his department. The departments responsible for assessment and collection also lacked an active file that would allow them to trace its recent processing. The director clarified, however, that he had only taken office in January 2025. He thus limited his explanations to the files he had actually inherited and the information available within the departments under his responsibility.
These amounts are raising questions among members of parliament.
This lack of transparency prompted further questions from parliamentarians. They recalled that around 2016, a procedure conducted by the Large Business Center, in collaboration with an entity referred to during the discussions as Orx or Oris, reportedly resulted in the issuance of tax assessments valued at nearly 100 billion FCFA. According to information presented during the hearing, however, this procedure did not lead to actual recovery of the announced amounts. The members of parliament also questioned the evolution of the case, particularly the shift from an initial assessment of approximately 100 billion FCFA. The reasons for this discrepancy, as well as the circumstances under which the procedure lost momentum, remain unclear. The discussions alone did not establish the precise causes of this shift or determine any potential responsibilities in the handling of the case.
Makhaly Faye invokes the limits of his responsibility
When questioned about potential past management failures, the Director of Large Enterprises reiterated that it was not his role to replace the oversight bodies in auditing the actions of his predecessors. He emphasized the need to distinguish his current responsibilities from those related to procedures initiated before his arrival. He did, however, indicate that research conducted in the archives had uncovered some letters and correspondence pertaining to Adax. These documents are to be submitted to the parliamentary inquiry committee to contribute to reconstructing the case's history. While reaffirming his respect for the National Assembly and the Senegalese people, Makhaly Faye stressed his obligation to adhere to the information officially available to him and to uphold the oath he took during his hearing.
