Affaire des 37 milliards F CFA : « AEE Power est animé de mauvaise foi », dit Tidiane Sall, représentant de la RV en France
The legal battle surrounding the 37 billion CFA francs disbursed to AEE Power continues on two fronts, in Senegal and Spain. Both proceedings are at a standstill. This was explained by Tidiane Sall, head of the Republic of Values (RV) party in France, during an interview with Macoumba Bèye on RFM radio.
Mr. Sall is behind the complaint filed by his party in Spain against AEE Power, the company headed by José Ángel González Tausz, president and executive director of the Spanish company.
A Spanish procedure hampered by the silence of AEE Power
Filed on January 19, 2026, the complaint quickly had its first effects. As early as February 24, the Spanish court sent requests to the Spanish bank and the export credit agency guaranteeing the loan. "The bank responded within the allotted time, in 72 days. However, AEE Power, the party most directly affected, did not respond to the first request. It took a second request for them to deign to react, five months after the complaint was filed. Their argument: they claim not to have received the first one," he explains.
In its belated response, AEE Power did not address the merits of the case. It asked the Spanish judge to dismiss the proceedings outright, arguing that the plaintiff lacked standing to sue due to a lack of direct personal interest, according to Tidiane Sall.
Ten charges in Senegal
In Dakar, the complaint was filed on October 16, 2025. The most recent development is a statement from the financial prosecutor's office announcing the addition of seven new charges to the initial three, bringing the total to ten. Among the new charges are influence peddling, corruption, money laundering, and conflict of interest.
These offences, Tidiane Sall points out, generally involve public officials or people located in the decision-making chain.
It is in this context that AEE Power announced that it would no longer respond to summonses from the Senegalese justice system, arguing the existence of a parallel investigation in Spain.
“This is where things get interesting, and it smacks of bad faith. AEE Power claims it will no longer respond to Senegalese courts because an investigation is underway in Spain and it prefers to respond there. But in its belated response to the Spanish justice system, it asks the judge to dismiss the case, arguing that I lack standing to sue due to a lack of personal interest. In short: it doesn't want the Senegalese justice system to question it, nor does it want the Spanish justice system to actually investigate the case on its merits,” denounces Tidiane Sall.
An alert ignored before the disbursement
Despite instructions from the authorities, the funds were disbursed. “ The 37 billion was indeed disbursed even before the work began, and AEE Power knew this before anyone else. On May 13, 2024, Baba Diallo, then Director General of the Senegalese Rural Electrification Agency (ASER), wrote to the Ministry of Finance requesting the suspension of payment. Despite this warning, the money was paid on June 11, 2024, 28 days later,” revealed Tidiane Sall, before adding: “We would like to know who gave the order to pay despite Baba Diallo’s warning,” declared the RV representative in France.
Towards international judicial cooperation?
When asked about the means available to the Senegalese justice system to compel AEE Power to answer for its actions, given that this is a public contract executed in Senegal with public funds, Tidiane Sall replied: “There is a judicial convention between Senegal and Spain, as well as between Senegal and France. Mutual legal assistance is entirely possible. Regarding corruption, there is even a United Nations convention ratified by both countries. Nothing prevents the two jurisdictions from working together on this case. But ultimately, it is up to the Senegalese government to decide.”
"To repay in the name of the people, to activate these mechanisms if they so wish. What is certain is that despite the diversion and the media campaign surrounding this case, it will not end there. We will find out who pocketed these 37 billion and what the responsibilities are at each link in the decision-making chain , " he asserts, expressing confidence in the progress of the Spanish procedure, now that the judicial recess is over.
Regarding a possible international arrest warrant that the Senegalese financial prosecutor's office could issue against AEE Power officials, Tidiane Sall remains cautious: "The financial prosecutor's office has its own legal instruments. It knows what it has to do. We are waiting to see how it intends to act."
