«J’avais l’impression d’être…» : usure, transitaire et conteneurs fantômes, le récit des investisseurs piégés
A complaint involving damages of 58.4 million CFA francs led the Keur Massar Research Brigade to dismantle an alleged usurious loan network run by female traders from the Dakar suburbs.
The defendants, D. Dioum and D. Mboup, are suspected of having lured investors by leading them to believe that their funds were being used to clear containers through customs at the Port of Dakar, with the promise of a return of 200,000 FCFA per million FCFA loaned every twenty days, representing an interest rate of 20%. The case, reported by L'Observateur, has been adjourned for deliberation by the Pikine-Guédiawaye court of summary jurisdiction, which will deliver its verdict on July 20.
At the hearing, the same source detailed, several plaintiffs recounted having invested significant sums, sometimes after taking out loans or selling their assets. Mr. Sène stated that he had handed over 5.7 million, while F. Watt maintained that she had lent 50.4 million, of which she claimed to have recovered only 11 million. "I felt like I had been bewitched," she declared in court, explaining that she had been regularly persuaded to inject new funds.
D. Dioum, quoted in the newspaper, admitted to taking out several loans to maintain her business in Gadaye, claiming she had been caught in a spiral of debt. She stated that a loan of one million CFA francs required her to repay up to 60,000 CFA francs per day. She also claims to owe several million CFA francs to various creditors, while asserting that she has already made repayments, and exonerates her co-defendant.
D. Mboup, prosecuted for complicity in fraud and using usurious interest rates, denies having acted as a freight forwarder. However, she admits to having received 31 million Watt francs to give to D. Dioum and to having called the creditors to announce the arrival of supposed containers requiring urgent payments.
The defense lawyers argued for acquittal, maintaining that it was a civil dispute and that no fraudulent activity had been established. The prosecutor, for his part, requested that the law be applied.
