Piratage à Mboro : Quatre câblodistributeurs traînés au tribunal par Canal+

Four cable distributors residing in Mboro, identified by the initials D. Thiongane, A. Guèye, M. Samb, and D. Mbaye, appeared before the Thiès court of summary jurisdiction in a case opposing them to Canal+. They are being prosecuted for the fraudulent recording and unauthorized rebroadcasting of images belonging to the audiovisual group.

In court, the defendants contested some of the accusations against them. D. Mbaye admitted that Canal+ decoders had been discovered and seized during the inspections.

However, he maintained that he did not use them in his business activities. According to his statements, his installations operated via satellite and not through Canal+ equipment. He also indicated that he did not possess any authorization allowing him to operate as a cable distributor.

For his part, D. Thiongane asserted that he held a valid license and specified that Mr. Samb worked under his supervision. Recounting the circumstances of the search, he explained that gendarmes had forced their way into his office while he was out of town in Mboro. He denied operating or broadcasting the Canal+ channels, even though the investigation revealed that Canal+ decoders had been found on the premises. According to D. Thiongane, his equipment only received channels broadcast via publicly accessible satellites.

D. Mbaye also denied having captured and rebroadcast the Canal+ images.

After hearing from the various parties, the public prosecutor determined that the evidence in the case file was sufficient to substantiate the charges against the defendants. Considering the offenses established, he requested that the law be applied to them.

The defendants' lawyers argued that there was no evidence to confirm that the accused were using Canal+ images. They emphasized that no one can possess a Canal+ decoder without a subscription and installation performed by Canal+ agents. The defense therefore pleaded for the outright acquittal of the defendants and the return of their equipment.

The verdict is scheduled for June 24, 2026.
