Terrain litigieux, chantier inachevé, coups de bâton : trois suspects écroués par le procureur de Rufisque
In the space of two days, the Tivaouane Peulh Local Police Brigade arrested three individuals in connection with three separate cases: two cases of breach of trust and real estate fraud, and one case of assault and battery. Following the investigation, the three suspects were brought before the Public Prosecutor at the Rufisque High Court, Cheikh Diakhoumpa, on Friday, who ordered their detention.
First case: a plot of land sold twice
On August 31, 2026, the gendarmerie in Tivaouane Peulh took into custody C. NDAO, 66, a building contractor residing in Tivaouane Peulh. He is accused of breach of trust and real estate fraud involving two million one hundred thousand (2,100,000) CFA francs, to the detriment of A. NDIAYE.
The investigation was opened following a referral from the public prosecutor at the Rufisque High Court, Cheikh Diakhoumpa, concerning a residential plot valued at the aforementioned sum. According to the complainant, A. Ndiaye, who has resided in the United States since 2015, acquired this plot from C. Ndao. After the acquisition, he undertook the construction of a perimeter wall to secure the property.
However, it turned out that the plot of land was disputed. The structures built there were subsequently demolished by SIPRES, according to their account. Having been informed of the situation, C. NDAO, in his capacity as the transferor, pledged to find a solution to the harm suffered by the plaintiff.
But despite several attempts, he allegedly never honored this commitment, leading the desperate complainant to file a complaint with the public prosecutor's office to assert his rights. The case was then transferred to the commander of the Tivaouane Peulh gendarmerie, who was tasked with the investigation and the arrest of the accused.
When questioned about the events, C. NDAO acknowledged them without dispute. He requested a delay in order to provide the plaintiff with another plot of land as compensation for the damage suffered.
Second case: an advance payment for work that was never honored
On the same day, August 31, 2026, the Tivaouane Peulh Local Police Brigade also detained Mr. Diop, 54, a mason residing in the Baye Fall Niang neighborhood of Tivaouane Peulh. He is being prosecuted for breach of trust and real estate fraud.
This case stems from a referral from the public prosecutor at the Rufisque High Court concerning the construction of an apartment foundation and the renovation of a studio. According to the plaintiff, R. SOW, she had given the accused an advance of 1,967,600 CFA francs intended for these works.
After receiving payment, Mr. Diop allegedly failed to complete the agreed-upon work or honor his commitments. Desperate, the complainant filed a complaint with the public prosecutor's office to assert her rights. The case was then forwarded to the Tivaouane Peulh gendarmerie, tasked with compelling Mr. Diop to fulfill his obligations.
When questioned, Mr. Diop admitted to the facts without dispute. He requested an extension to resume and complete the work, explaining that he had been involved in a traffic accident in March.
Third case: an altercation between workshop neighbors
The third arrest took place on September 1, 2026, at 7:00 PM, when the Tivaouane Peulh Local Police Brigade took C. NDIAYE, 32, a shopkeeper residing in Tivaouane Peulh, into custody. He is accused of assault and battery resulting in a seven-day period of temporary incapacity for work (ITT).
According to the statements of the complainant, I. NDIAYE, also a trader, he operates a workshop located near that of C. NDIAYE.
He claims that the accused frequently visited his workshop and insulted him on several occasions.
The events themselves allegedly took place on August 31, 2026, around 3 p.m. I. NDIAYE was in his workshop with a friend when C. NDIAYE allegedly approached him and began insulting him again.
A verbal altercation reportedly broke out between the two men. According to the complainant, the accused then went to his canteen to get a stick, with which he struck him several times, causing an injury to his right arm and headaches.
Injured, I. NDIAYE went to the Clinique de la Paix, where he received a medical certificate documenting his injuries and prescribing a seven-day period of incapacity for work. He then filed a complaint with the Tivaouane Peulh Local Police Brigade, accompanied by this certificate, in order to pursue legal action.
When questioned about the events, C. NDIAYE admitted to striking I. NDIAYE. However, he maintains that the complainant attempted to stab him with a knife and asserts that he acted only in self-defense.
At the end of the investigation carried out by the Tivaouane Peulh Local Brigade, the three suspects C. NDAO, M. DIOP and C. NDIAYE were presented this Friday before the Public Prosecutor at the High Court of Rufisque, Cheikh Diakhoumpa, head of the prosecutor's office, who formalized their placement under a detention order.
