Thiès : il profite d’un accident de la circulation pour voler la moto de la victime
A worker injured in a traffic accident in Thiès lost his Jakarta motorcycle under suspicious circumstances. Mr. Guèye, the driver, who was being prosecuted for theft, appeared in court after being accused of taking the motorcycle under the pretext of protecting it. The public prosecutor requested a two-year prison sentence, with one year to be served.
The incident occurred near the Brioche Dorée bakery in Thiès. According to A. Samb, the plaintiff, he was returning from a construction site in the Keur Massamba Guèye neighborhood when he was involved in a traffic accident. Injured, he was surrounded by several people who came to check on his condition.
It was at this point that Mr. Guèye offered to watch his motorcycle while he was taken to the hospital. Suspicious, the worker, who claims not to know the accused, preferred to entrust his vehicle to someone he knows.
But, according to his testimony in court, the driver then went to her and asked her to move the motorcycle and park it at her home, claiming to live nearby. He specifically stated that the motorcycle needed to be secured to prevent it from being seized by the police.
Taking advantage of the victim's evacuation by firefighters, the defendant stole the motorcycle and disappeared. The plaintiff claims that the motorcycle has not been found since. To compensate for the damages suffered, A. Samb has claimed 350,000 FCFA in damages.
The defendant, Mr. Guèye, contested the charges against him. He maintained that he had moved the motorcycle to protect it and prevent the police from seizing it.
In his version of events, he says he then entrusted the vehicle and his mobile phone to another person. Upon returning to retrieve them, he explains, this person allegedly told him they had sold everything, without providing any further explanation.
This version of events failed to convince the prosecution. The public prosecutor maintained that the offense of fraudulent removal was established, accusing the defendant of having moved the motorcycle without the owner's knowledge.
He therefore requested a two-year prison sentence, including one year of mandatory imprisonment.
The court has taken the case under advisement.
