In a press release dated October 2, 2026 (No. 003/PR-TGIHC DK), the Public Prosecutor at the High Court of Dakar informed the public of the progress of a sensitive investigation. This investigation concerns offenses related to political and judicial events that occurred between 2021 and 2024. According to the prosecutor's office, these acts, "due to their scale and systematic nature," are likely to constitute crimes against humanity.
The magistrate explains that he received the instruction to open this investigation by two letters: the first, numbered 559/MJ, dated July 28, 2025, and the second, numbered 0260/PGDK, dated July 30, 2025. By a letter dated August 4, 2025, the Squadron Leader commanding the Research Section of the National Gendarmerie in Dakar was notified for this purpose.
Initial reports: 76 dead and more than 200 suspected victims of torture
Initial investigations, conducted between October 2025 and September 2026 based on available documents, have provisionally identified 76 deaths, including 41 in the Dakar region alone. They have also identified more than 200 other individuals presumed to be victims of torture or inhuman, cruel, or degrading treatment.
Investigators interviewed 166 people, including victims and witnesses. According to the statement, the analysis of these interviews and medical records revealed evidence of assassination, murder, persecution, torture, and other inhuman, cruel, or degrading treatment. The prosecutor's office believes these acts may constitute crimes against humanity.
Arrests linked to the cases of Pape Abdoulaye and Mamadou
The investigators' efforts led to the arrest of four individuals suspected of participating in acts of torture against Pape Abdoulaye Touré. The statement also mentions a fifth individual, targeted following the death of Mamadou Ndoye. The statement specifies that Ndoye was "deliberately struck and killed" in Bargny by a police vehicle. The identities of those arrested are not disclosed in the document.
Indictments dated September 23, 2026
On September 23, 2026, all these individuals were charged with crimes against humanity, specifically torture and murder, by the jointly assigned investigating judges. They were then placed, one after the other, in different situations. Two of them were remanded in custody, while the others were placed under judicial supervision or house arrest with electronic monitoring.
The prosecution is appealing
On September 28, 2026, the Public Prosecutor, who had requested that all the defendants be remanded in custody, appealed this order. He is therefore contesting the less severe measures decided upon for some of the defendants.
The investigating magistrates assigned to the case have been instructed to issue judicial delegations, requests for assistance, requisitions, and letters rogatory, and to carry out all other investigative acts necessary to establish the truth. The Prosecutor also announced that further legal proceedings will be initiated before the competent courts, depending on the levels of responsibility revealed by the investigation.
