The debate surrounding the date of Prime Minister Ahmadou Al Aminou Lô's General Policy Statement (DPG) has sparked a heated controversy between the Executive branch and the Bureau of the National Assembly. To clarify the legality of the procedures followed, legal expert Mouhamadou Moustapha Sy provides a detailed analysis of the respective powers of the President of the Republic and the national representation.
A duality of legal skills
When asked whether the National Assembly has the exclusive power to set the date of the plenary session, the legal expert offered a crucial distinction: “To say that the Assembly decides alone would be excessive. Each institution intervenes at a different stage of the procedure.” While the Head of State, Bassirou Diomaye Faye, legitimately exercised his constitutional prerogative by convening the extraordinary session through decree no. 2026-1530, effective September 1, 2026, setting the schedule for the debates remains a parliamentary prerogative.
According to the legal expert, the organization of the plenary session must "then be determined according to parliamentary procedure, in particular by the Conference of Presidents, in accordance with Articles 22 and 77 of the Rules of Procedure."
Login and work schedule
The legal expert clarifies that the presidential decree opening the session on September 1st at 10:00 AM does not mandate the immediate delivery of the Prime Minister's address that same day. "Convening a session on September 1st does not automatically mean that all the items on the agenda must be completed that same day," he emphasizes, noting that this first session is traditionally reserved for administrative formalities.
Regarding the organizational deadline, Mouhamadou Moustapha Sy points out that Article 109 of the Rules of Procedure stipulates that the Assembly must be informed "at least eight days before the date set for the General Policy Statement." The disagreement lies in the application of this text: "The eight-day period is included in the rules. The debate mainly concerns its starting point and how it should be applied in this particular situation."
Value of the correspondence from the Prime Minister's Office
Regarding the letter sent on August 24th by the Prime Minister's office informing of the Prime Minister's availability for September 1st at 9 a.m., the analyst points out that "this correspondence demonstrates the Prime Minister's willingness and availability, but it does not, in itself, constitute the legal act that sets the date for the parliamentary session."
A call for respect for institutional rules
In conclusion, Mouhamadou Moustapha Sy calls for a calm interpretation of the constitutional and regulatory texts: “We must not transform a procedural matter into a conflict between institutions. The President has the power to convene, the Assembly has its own rules of procedure, and the Prime Minister has a constitutional obligation to present his policy statement.” According to him, “the most important thing now is to find, while respecting the Constitution and the Rules of Procedure, a solution that allows for the peaceful presentation of this policy statement.”
