Tribunal de Pikine-Guédiawaye : Un receveur de bus Tata condamné à 6 mois ferme pour avoir détourné 30 000 FCFA du compte Wave d’un non-voyant
Cheikh Matar Mbaye, a Tata bus conductor residing in Thiaroye, was sentenced this Friday to six months in prison by the Pikine-Guédiawaye court of summary jurisdiction. He was prosecuted for unauthorized access to a computer system and obtaining an undue advantage through fraudulent entry into a computer system. He had fraudulently emptied the account of a blind man.
According to the prosecution, the incident occurred during a journey on a Tata bus. The complainant, Séga Seck, who is blind, had received a photo via WhatsApp of a sheep he was considering buying for Tabaski (Eid al-Adha). Unable to see the image, he approached the conductor to ask him to check if the ram met his expectations.
But the man did not stop at this request. Taking advantage of the victim's trust, Cheikh Matar Mbaye managed to access Séga Seck's Wave account and steal 30,000 FCFA, which he then fraudulently transferred.
In court, the defendant admitted to the facts. Offering his apologies, he explained that he had made "a mistake" and indicated that he had reimbursed the entire amount embezzled.
Séga Seck stated that he had forgiven the defendant after receiving his money back. He did not claim any damages.
The public prosecutor requested the application of criminal law, while the defense, represented by Mr. Alioune Badara Ndiaye, asked for the court's leniency.
Despite the victim's forgiveness and the reimbursement of funds, the court found Cheikh Matar Mbaye guilty and sentenced him to 6 months in prison.
