The debate surrounding the amendment of Article 37 of the Constitution is taking a political turn in the National Assembly. Originally introduced by a bill proposed by MP Amadou Ba, the reform concerns, in particular, the asset declarations of the highest state authorities. Indeed, Article 37, found in Title III of the Constitution dedicated to the President of the Republic, sets out the provisions relating to the Head of State, notably regarding asset declarations.
The text was adopted by the Council of Ministers with a government amendment extending the asset declaration requirement, both upon entering and leaving office, to the Prime Minister and the President of the National Assembly. Guy Marius Sagna does not view this extension favorably from a constitutional and symbolic standpoint. According to the MP, associating the Prime Minister and the President of the National Assembly with a provision contained in a section specifically dedicated to the President of the Republic amounts to " diminishing " the presidential office.
During a plenary session this Monday, the MP questioned the Minister of Justice about the implications of the government amendment. He argued that the debate should clearly establish everyone's responsibilities regarding this change. " Diomaye is here to govern. Let him bear the consequences ," he essentially stated, before emphasizing the need to have the government's position precisely recorded in parliamentary debates.
Addressing the Minister of Justice directly, Guy Marius Sagna specifically requested that it be clearly stated that the amendment originated from the government. He deemed this precaution necessary to prevent the responsibility for this change from being attributed solely to parliamentarians in the years to come. " It must be stated that it was you, so that in 100 years, people don't think that the Pastef deputies knew nothing about it ," he declared in plenary session.
Behind this exchange of blows lies a debate that goes beyond the purely technical question of the declaration of assets: that of the place of the President of the Republic in the constitutional architecture and of the political responsibility of those who carry out the amendments to the Fundamental Law.
