Before the members of the Parliamentary Commission of Inquiry into Tax Exemptions, the Director General of Customs, Malick Mbaye, sought to clarify the technical and legal aspects of the debate. Rejecting the term "revenue abandonment," the head of the customs service drew a clear distinction between tax suspension regimes and legal exemptions, while emphasizing the lack of discretionary power within his administration. To inform the commission's work, Customs announced the submission of a comprehensive inventory of tax data covering the period 2014-2026.
The debate surrounding state-granted tax advantages took a clarifying turn during the hearing of Malick Mbaye, Director General of Customs, before the Parliamentary Commission of Inquiry. In response to questions from parliamentarians, the head of the customs administration emphasized the legal framework surrounding tax suspension regimes, exemptions, and tax expenditures, refuting the notion that these mechanisms constitute genuine and irregular financial losses for the public treasury.
Suspension regime: Deferred but not waived debts
One of the points of clarification provided by Malick Mbaye concerns the suspensive regimes, applied in particular to goods held in customs warehouses, under temporary admission, or intended for processing. According to the Director General, the application of this mechanism cannot be described as a "waiver of revenue."
In reality, this is a temporary suspension of the payment of duties and taxes. The tax debt is not cancelled: it becomes payable as soon as the products are released for consumption on the domestic market, or is extinguished if the export customs obligations are met.
Legal exemptions: A tax expenditure regulated by law
Recalling the regulatory framework governing tax exemptions, Malick Mbaye stressed that an exemption results exclusively from legislative provisions provided for by the texts in force, in particular the Customs Code, the Investment Code, the Mining Code, the Petroleum Code or international conventions.
The Director General emphasized that Customs has no discretionary power to grant tax exemptions on its own initiative. Its role is strictly limited to verifying the accuracy of declarations, applying regulations (particularly Article 260 of the Customs Code), and assessing duties. Actual collection then falls under the exclusive jurisdiction of the Treasury. For the Customs administration, a legally granted exemption constitutes a tax expenditure resulting from a public policy, and not an arbitrary relinquishment of resources.
Rigorous control reinforced by the GRET and GAIN computer systems
To counter the risks of fraud and diversion of goods, the customs administration relies on a structured, multi-phase control system. The preliminary investigation is carried out by the Franchise Office, while quota monitoring and the traceability of economic regimes are performed digitally using the GRET system, integrated into the GAIN IT platform.
At the time of customs clearance, the exact correspondence between the exemption certificates and the goods is rigorously verified. Finally, post-clearance checks are carried out by the investigative services and the joint Tax-Customs unit to ensure that goods exempted for social, agricultural, or industrial projects are not diverted to unauthorized commercial channels.
Provision of tax data from 2014 to 2026
Demonstrating transparency before the national representation, Malick Mbaye announced the provision to members of parliament of a comprehensive database listing all exemptions recorded between 2014 and 2026.
This consolidated data will allow the members of the Commission of Inquiry to accurately analyze the mapping of benefits granted, to assess the real financial impact of these tax expenditures and to evaluate the effectiveness of the regulatory mechanisms put in place by the State.
