Fonds spéciaux : L'Assemblée snobe le vote bloqué du gouvernement, rejette ses amendements et adopte l'article unique
This is another setback for the government in its standoff with the National Assembly over the regulation of special funds. Meeting in plenary session this Thursday, October 1st, 2026, the deputies rejected all the amendments put forward by the Minister of Justice, Keeper of the Seals, Moussa Sarr, before adopting the single article of the proposed organic law amending the law relating to finance laws.
To justify its amendments and its use of a blocked vote, the executive branch cited requirements for compliance with Directive No. 06/2009/CM/UEMOA, issues related to the allocation of funds, and the preservation of the role of the Court of Auditors. This argument failed to convince the assembly.
Government amendments rejected by the majority
The parliamentary majority ultimately did not follow the position defended by the Minister of Justice. The rejection of the government amendments allowed the members of parliament to maintain intact the provisions of the draft organic law, as previously adopted in committee.
Among the contested amendments was that of Article 14, by which the government sought to remove the specific reference to special appropriations or funds and integrate them into the overall budget of constitutional institutions. Similarly, the amendment to Article 70, intended to provide a different framework for parliamentary oversight of the use of these appropriations, was rejected. These proposals from the executive branch had already been initially rejected by the Finance and Budgetary Control Committee.
The single article was adopted and the parliamentary line maintained
Following the rejection of the executive's amendments, the members of parliament voted on the single article of the proposed organic law. This vote allows the legislation, championed by the national representation, to continue its legislative process in the exact wording desired by parliamentarians.
The stated objective remains to strengthen the oversight and transparency of these sensitive resources. The text notably provides for the explicit inclusion of special appropriations or funds in budget allocations and the establishment of appropriate parliamentary oversight mechanisms.
This decisive vote comes after several weeks of institutional confrontation over the management of public funds. As a reminder, an initial bill was declared inadmissible by the Constitutional Council on August 25, 2026, the Council members having determined that certain provisions fell within the domain of organic law and regulatory power. By adopting this single article against the government's wishes, the National Assembly confirms its determination to impose stronger oversight of special funds.
