Fonds spéciaux : Les amendements de Me Moussa Sarr rejetés, ce que voulait changer le Gouvernement
The Government wished to revise several provisions of draft organic law no. 38/2026 governing the management of special appropriations. Compliance with WAEMU rules, consideration of social emergencies, procedures for parliamentary oversight, and ministerial hearings: the Minister of Justice, Moussa Sarr, defended three strategic amendments, which were ultimately rejected by the Finance Committee.
In the Finance and Budget Control Committee, the debate on the management of special appropriations went beyond the traditional opposition between transparency and confidentiality. Represented by the Minister of Justice, Keeper of the Seals, Moussa Sarr, the Executive reaffirmed its commitment to the principle of transparency in the management of public funds. However, it emphasized that several provisions of the text raised complex legal and practical difficulties. At the heart of the government amendments: the modification of Articles 14 and 70 of the organic law relating to finance laws.
WAEMU and social emergencies: The arguments of the Minister of Justice
Regarding Article 14, the Government proposed deleting the last bullet point and the reference to a specific law responsible for determining the procedures for controlling special funds. Mr. Moussa Sarr specifically cited the need to bring the text into compliance with Article 14 of Directive No. 06/2009/CM/UEMOA concerning finance laws within the community area.
The Minister of Justice also pointed out a legal loophole regarding the designation of the authorizing officer responsible for executing these allocations. Since the proposed law did not specify this authority, the government suggested referring to the provisions of Article 67, which governs the conditions for executing state allocations.
Another key argument put forward by the minister is that the special funds do not only cover defense, security, or intelligence. According to explanations provided to the committee, these funds are also used during social emergencies or national solidarity actions—particularly for providing aid to bereaved families, urgent medical care, or preserving social cohesion.
Regarding Article 70, Mr. Moussa Sarr sought to define the scope of parliamentary oversight. The amendment aimed to remove the specific reference to oversight of the "use" of funds, while maintaining the Finance Committee's oversight powers during the annual budget execution. Furthermore, the Government requested that hearings with members of the Executive branch remain strictly governed by the National Assembly's Rules of Procedure.
Format adjustments and rejection by committee
The government proposals also included formal corrections. Mr. Moussa Sarr requested the reinstatement of the exact title of Organic Law No. 2020-07 as published in the Official Journal, as well as the refocusing of the constitutional references in the explanatory memorandum on Article 67 of the Constitution (relating to the determination of the State's expenditures and resources).
Despite these arguments, the three amendments put forward by the Minister of Justice did not convince the majority of members of the Finance and Budgetary Control Committee, who rejected them.
Draft organic law no. 38/2026 was therefore adopted as is by the committee. The final decision now rests with the plenary session, where members of parliament will have to decide between extending parliamentary oversight, respecting WAEMU community standards, and preserving the discretion necessary for certain state interventions.
