Réforme budgétaires : Ce que change l'amendement n° 3 de Me Moussa Sarr pour les députés et la Cour des Comptes
A significant new adjustment has been made to draft organic law no. 2020-07 of February 26, 2020, concerning finance laws. In an official document dated October 1, 2026, the Minister of Justice, Keeper of the Seals, Moussa Sarr, introduced amendment no. 3, which redefines the wording of article 70 of the text.
In the summary statement, the Minister of Justice specifies that "this amendment aims to refocus article 70 on its specific purpose, as defined by article 67 of the Constitution and article one of organic law no. 2020-07, which only empower the organic law relating to finance laws to set the rules relating to the content, presentation, preparation, adoption, execution and control of finance laws".
Strict alignment with the WAEMU and constitutional jurisprudence
The government recalls that the reinstatement, in the first paragraph, of the clarification that the Commission in charge of Finance exercises its control "during the annual management" makes it possible to restore the exact wording of article 74 of directive no. 06/2009/CM/UEMOA of June 26, 2009.
The text emphasizes the legal scope of this compliance: "This fidelity constitutes, as the Constitutional Council ruled in its decision no. 1/C/2020 of February 24, 2020, an obligation of constitutional value."
Preserve the exclusive prerogatives of the Court of Auditors
One of the central motivations for this amendment lies in the strict separation of institutional powers. The government has therefore removed the clause granting ex-post control over the use of funds to the parliamentary committee.
“The elimination of the power to audit the use of funds at the end of each budget cycle stems from the fact that this prerogative would encroach upon the Court of Auditors’ specific jurisdiction regarding the proper use of public funds,” argues Mr. Moussa Sarr. The ministerial rapporteur emphasizes that “since the relationships between constitutional institutions are organized and governed by the Constitution itself, it is not within the purview of the organic law relating to finance laws to grant the Finance Commission an oversight power that falls under the purview of another constitutional institution.”
Increased transparency and mandatory quarterly reports
The new version of Article 70 enshrines the right to information for parliamentarians and citizens. It stipulates that "the Finance Committee shall ensure, during the annual management period, the proper execution of the finance laws."
To this end, "the Government submits quarterly budget implementation reports to the National Assembly for informational purposes. These reports are made available to the public." Furthermore, the text guarantees full transparency in investigations by specifying that "any information or on-site investigations that the National Assembly may request cannot be refused."
Finally, the amendment adapts the procedures for hearing ministers: “The National Assembly may hold hearings with ministers. It submits a request to the President of the Republic, under the conditions set forth in Article 70, paragraph 2, of the Rules of Procedure of the National Assembly.” This amendment, the Minister of Justice concludes, “addresses the need to bring this provision into line with the spirit of the Rules of Procedure of the National Assembly.”
