Following his controversial article entitled "Imposter," Mary Teuw Niane, the Minister and Chief of Staff to the President of the Republic, has issued another statement, this time defending the President's stance in the face of recent institutional tensions. In an opinion piece titled "Republican Elegance," he reiterates the constitutional role of the President and emphasizes the need to maintain the balance of power within the institutions.
According to him, the President of the Republic is not an ordinary political actor, but the guarantor of the Constitution, the proper functioning of institutions, and national unity. " Sometimes we have to reiterate the obvious when political passions end up obscuring them. In Senegal, in our country, the President of the Republic is not just another institutional actor. The Constitution entrusts him with a unique responsibility: he is its guardian, the guarantor of the proper functioning of institutions, and the embodiment of national unity. This is neither a privilege nor a favor. It is a duty. And a duty sometimes requires resistance ," he said.
In this capacity, he affirms, the head of state has a duty to intervene when the foundations of the Republic appear to be threatened, in particular by favouring recourse to the law and the competent institutions.
The Minister Chief of Staff emphasizes that, faced with certain parliamentary initiatives which he considers likely to disrupt the institutional architecture, President Bassirou Diomaye Faye has chosen the legal route by referring the matter to the Constitutional Council, rather than engaging in a political power struggle.
“ Faced with the obstinacy of those who seem to want to make an usurped parliamentary majority the instrument of a deconstruction of the republican architecture, he chose the law. He referred the matter to the Constitutional Council. No strong-arming. No institutional brutality. No circumvention of national representation. The law. The judge. The Constitution. And the constitutional judge has ruled ,” he affirms.
In his argument, Mary Teuw Niane points out that " a parliamentary majority, however strongly claimed, is not the Constitution " and that " an electoral victory does not grant ownership of the State ." He insists that, in a state governed by the rule of law, even political majorities must respect the limits set by the Fundamental Law.
“ No political majority is a license to do anything. In a true Republic, even the victors have limits. And that is precisely why the Constitutional Council exists ,” he reminds us.
The minister also emphasized the role of the Constitutional Council, which he described as an essential bulwark of democracy. According to him, this institution is neither an ally of the President of the Republic nor an adversary of Parliament, but the legal guardian of the Constitution, the one that reminds us that politics cannot do everything, that the majority cannot do everything, and that political urgency cannot abolish the rule of law.
“ His decisions may be displeasing. They may thwart current ambitions. They may even provoke the anger of those who believed their victory was definitive. But a Constitution is not meant to be respected only when it suits us. It is when power encounters a limit that we measure the strength of a Republic. That is why the role of the President of the Republic must be understood in its proper measure ,” he explains.
For Mary Teuw Niane, the head of state should not be a silent spectator to institutional upheavals. He believes he must fully exercise his authority. But, he emphasizes, this must be a constitutional authority, never arbitrary; a firm authority, without brutality, vigilant, without agitation; a determined authority, without overstepping its bounds.
Mary Teuw Niane calls for a return to "republican elegance", based on respect for institutions, separation of powers and submission of all, rulers as well as elected officials, to the Constitution.
“ Republican elegance is this: the strength that accepts to bow before the law. It is knowing that a party is not the State. That a majority is not the Nation. That a mandate is not a license. And that an electoral victory, however resounding, remains a political victory, never a right of ownership over the Republic. Here, we must rediscover this dignity ,” he reaffirms.
According to Mary Teuw Niane, politics can be tough, debates can be heated, and disagreements can be deep. But, he emphasizes, there is a red line that no one should cross: the one that transforms the conquest of power into the conquest of institutions.
“ The Republic is not conquered. It is not possessed. It is served. And to serve the Republic is to accept its rules when they favor us as well as when they oppose us ,” he confides.
Mary Teuw Niane adds that when the President of the Republic carries out the mission assigned to him by the Constitution, when he defends the balance of institutions and chooses recourse to the judge rather than the balance of power, supporting him does not necessarily mean taking sides with a man.
For him, it is rather a matter of taking a stand for a conception of the State. He speaks of a conception in which power is strong, but not without limits; of a conception in which Parliament is sovereign in its domain, but not above the Constitution; of a conception in which the constitutional judge is neither an obstacle nor an adversary, but one of the bulwarks of our democracy.
Mary Teuw Niane speaks mainly of a conception in which the President of the Republic fully assumes what the Constitution expects of him: to keep the Constitution, to guarantee the institutions and to keep the State standing when the political storm arises.
He believes that this is what republican elegance is all about, but not weakness, complacency, or silence. Rather, he believes it is controlled authority, firmness without brutality, power subject to the law, and the Republic placed above all.
