18 semaines de congé maternité, protection sociale des indépendants : Ce qui change avec le nouveau Code du travail
Extension of maternity leave from 14 to 18 weeks, regulation of teleworking, social security coverage for self-employed workers, and strengthened measures against harassment: the Ministry of Public Service presented the major advances of the new Labor and Social Security Codes. Speaking to the press on Thursday, October 1, 2026, Minister Mamadou Lamine Dianté and the Director of Labor, Ramatoulaye Niang, emphasized that some fifty implementing regulations accompany these major reforms, which resulted from ongoing social dialogue.
The new Labor and Social Security Codes were the focus of a press conference held on Thursday, October 1, 2026, by the Ministry of Public Service, Labor, and Public Service Reform. Addressing journalists, the Director of Labor and Social Security, Ramatoulaye Niang, outlined the main changes introduced by the two texts, while Minister Mamadou Lamine Dianté discussed the conditions for their implementation and the role of social dialogue.
Major advances for employees and the informal economy
In her presentation, Ramatoulaye Niang emphasized several changes that directly affect the daily lives of workers. The new Labor Code notably extends maternity leave from 14 to 18 weeks and strengthens the legal framework against moral and sexual harassment, violence in the workplace, and discrimination.
The right to withdraw from work is also enshrined in law for situations of serious and imminent danger. Furthermore, teleworking now has a clear legal framework, while occasional contracts are now included in the regulatory system. The digitization of several personnel management procedures is also among the changes presented.
On the social security front, the reform establishes a mandatory scheme for self-employed workers. It introduces mechanisms designed to facilitate registration and contributions from small economic units and those operating in the informal economy.
Furthermore, the definition of a workplace accident has been broadened to include new forms of work organization, including teleworking. The director also outlined the provisions relating to disability, supplementary retirement, and the modernization of the governance of social security institutions.
More than 50 regulatory texts to implement the reform
Beyond the content of the texts, the question of their effective implementation arose during discussions with the media. Ramatoulaye Niang announced that more than fifty implementing texts (decrees and orders, already being drafted) are needed to make these measures operational.
Minister Mamadou Lamine Dianté clarified that the promulgation of the Codes did not end consultations with social partners. On the contrary, the drafting phase of the implementing decrees opens a new stage of dialogue with representatives of workers and employers.
The minister defended a participatory approach, asserting that sectoral concerns can still be addressed within the regulatory framework. He also reviewed the state of social dialogue and the monitoring of commitments made to trade unions.
