Acte contre nature et usage de drogue : Trois hommes envoyés en prison par le procureur Dicko
The case began with a rather unexpected statement at the Golf-Sud police station. El. HM Diack went to the station on September 14th to request police assistance. In his initial statement, he claimed to have been in a romantic relationship with AA Kandé for over a year and mentioned paid sexual encounters.
A few hours later, he recanted. He denied being homosexual and even accused the officer present at the station of having altered his statements.
That day, El. HM Diack, 35 years old, residing in Guédiawaye, a parking lot manager and Yango delivery driver, went to the police station. Initially, he stated that he wanted to report a personal situation that was weighing on him and request the assistance of the police officers.
According to the entry in the police report, Diack claimed to have been in a romantic relationship with Kandé for over a year. He also stated that Kandé paid him 10,000 CFA francs after each sexual encounter. Lacking this amount, he gave Kandé his Infinix mobile phone as collateral.
When questioned again by investigators, El. HM Diack changed his story. He denied being homosexual and explained that Aziz Kandé was simply a childhood friend. He did, however, admit to using crack cocaine.
Diack recounts leaving work around 1 a.m. on the night of September 12th to go to Kandé's house at the Béthio intersection to smoke crack cocaine. Around 6 a.m., having run out of drugs, he contacted Mr. Tall to replenish his supply. They met near the Brioche Dorée bakery.
It was at this point that he handed his Infinix phone to Mr. Tall as collateral. In exchange, Mr. Tall gave him two more rocks of crack cocaine. "We only smoked three rocks of crack," Diack told investigators, specifying that he had been using drugs for about a year. He also claimed to have bought the first three rocks from Mr. Tall for 15,000 CFA francs.
But Mr. Tall disputed this version of events. The 36-year-old mechanic, who lives in Guédiawaye, admitted to giving Diack 10,000 CFA francs in exchange for his phone, but denied selling him drugs. According to him, Kandé had called him to ask him to lend that money to Diack.
He claims to have met Diack around 7 a.m. at the Brioche Dorée intersection, as he was getting ready to go to Malibu beach. He maintains that Diack had given him his phone as collateral and then returned to retrieve it without giving him back the money.
Arrested at his home in the Las Palmas housing project, AA Kandé acknowledged knowing El. HM Diack, but described their relationship as a simple childhood friendship. He denied using crack cocaine with Diack. However, he admitted that Diack was at his home on the night of September 12. "He was just passing through to visit me," he explained.
Confronted with Diack's statements, who claims to have smoked crack cocaine at home before going with him to meet Mr. Tall, Kandé maintained his version of events. He stated that Diack had asked him to accompany him to borrow money from Mr. Tall. He waited in a shop while Diack pawned his phone.
Kandé also acknowledged knowing Mr. Tall, whom he described as a former neighbor. However, he denied having put the two men in contact for a drug deal.
What the phone reveals
The examination of AA Kandé's cell phone changed everything. Investigators report discovering exchanges with several people on his Snapchat account, as well as videos of a homosexual nature. Despite this, Kandé continues to deny being homosexual. He claims that the romantic messages found were exchanged with women and maintains that some videos of homosexuals were sent to him via Snapchat without him knowing the senders' identities.
The police then presented him with several screenshots depicting them as romantic exchanges with men. In one of them, a correspondent identified under the pseudonym " Bashmtl " exchanged messages with the phone's owner such as: "I adore you, you know"; "I adore you too"; "Ben goor Mo am si deuk bi té yaw leu… ligua ma won goor meussoumako wone", the report states.
Kandé, however, persists in his denials. He maintains that he simply has acquaintances on Instagram and Snapchat, some of whom identify as homosexual, but he does not share their sexual orientation. He agreed to hand over his iPhone 7 to investigators for technical analysis and provided them with his password.
As the interviews progressed, investigators encountered three different versions of events. El. HM Diack admitted to using crack cocaine and accused Mr. Tall of being his supplier. He denied, however, being homosexual, while claiming that his initial statements about his relationship with AA Kandé had been altered by the police officer who took them.
Mr. Tall only admits to having lent 10,000 CFA francs to Diack in exchange for his phone, but denies any sale of crack cocaine.
A. Kandé denies both the drug use allegations and those relating to any sexual relationship with Diack. He does, however, acknowledge knowing Mr. Tall and states that they were together on the night of September 12.
The trio were brought before the public prosecutor at the Pikine-Guédiawaye High Court on Wednesday. Saliou Dicko remanded them all in custody on charges of unnatural acts and offering or supplying drugs. They will be tried immediately.
