Concours d’entrée à l’ENA cycle A : La Cour suprême ordonne à la direction de recevoir la candidature d’Alassane Ndiaye Ndoye
Seized in summary proceedings, the administrative chamber of the Supreme Court ruled on Wednesday, September 30, 2026, in favor of Alassane Ndiaye Ndoye. The high court ordered the director general of the National School of Administration (ENA) to accept the application of this tax inspector before the registration deadline.
This is a decisive victory for Alassane Ndiaye Ndoye. A tax inspector by profession, he had been refused online registration for the ENA's Cycle A professional competition for the year 2026, on the grounds that he had exceeded the age limit of 53 years set by the school's management communiqué.
Feeling wronged and facing an absolute emergency as the closing date for submissions was set for Wednesday, September 30, 2026 at 6 p.m., the applicant appealed to the judge of summary proceedings through his counsel, Maître Sally Mamadou Thiam.
In his order no. 43 issued during the public vacation hearing of September 30, 2026, the judge of the summary proceedings ruled in favour of the applicant.
In justifying its decision, the court relied on Decree No. 2002-266 of March 6, 2002, which sets the age limit for candidates taking competitive examinations for civil service positions at 55 years old on January 1st of the year of the examination. By reducing this limit to 53 years old in its opening announcement, the ENA administration imposed a restriction contrary to the regulations in force.
The judge in chambers considered that this age requirement constitutes a "serious and manifestly unlawful infringement" of the applicant's right to participate in the competitions, especially since the latter has not yet reached the legal limit of 55 years.
The state cleared of wrongdoing
The State's legal representative (AJE) had raised the inadmissibility of the request against him. The Supreme Court granted this request, exonerating the State of Senegal from the case, recalling that the ENA is a public institution with legal personality and validly represented in court solely by its Director General.
For these reasons, the Supreme Court has urgently ordered the Director General of the ENA to register the candidacy of Alassane Ndiaye Ndoye before the deadline for closing the files.

Fallait oser. C'était pas gagné d'avance...
