États-Unis : un Sénégalais soutire 1 milliard F CFA à 11 investisseurs pour une vie luxueuse et des cadeaux à deux anciens ministres de Macky Sall
The U.S. Department of Justice (DOJ) is prosecuting a Senegalese man named Amadou KD. Eighteen charges are against him: fifteen for wire fraud, two for transactions involving products of alleged criminal origin, and one for international corruption.
Initially, the indictment, filed in May 2023, included 21 charges. Four months later, a twenty-second charge was added. But last February, the prosecution dropped four charges. These related to suspicious money transfers totaling $193,000 (approximately 110 million CFA francs); their removal thus reduces the prosecution to 18.
Amadou KD had permanent resident status in the United States. He lived in Laguna Niguel, a residential city in Orange County, California. The town is nestled in the San Joaquin Hills and boasts parks and protected natural areas that cover a third of its land.
At the helm of Virtual Advisors LLC and Liquide Inc, Amadou KD was active, according to the DOJ, in e-commerce and information technology, among other sectors. His favorite pastime was flaunting luxurious properties, high-end vehicles, and financial success. His goal: to demonstrate to potential business partners that he was financially sound.
This picture was misleading. The images of opulence did not match the reality of the life of this Senegalese man who claimed to own, without debt, high-end residences and asserted, without batting an eye, that he was among the richest Africans.
Eleven investors defrauded
According to Les Échos, which devoted a lengthy article to the case on Thursday, Amadou KD managed, between 2015 and 2020, to convince several investors to put money into projects in the technology, healthcare, real estate, and service sectors aimed at the African diaspora. "According to the indictment, [he] assured certain investors that he could finance these companies himself," the newspaper points out. "Their participation was intended only to demonstrate to major institutional investors that they themselves had invested money in the projects."
And to better ensnare its targets, the newspaper continues, "investors were invited to sign convertible debt acknowledgments with a term of one year. These contracts promised them a minimum return of 10%, the repayment of their capital or the possibility of converting their debt into an equity stake in the company. But in the end, these promises were not kept and a large part of the money was not used for the announced activities."
At least eleven investors were swindled. The American justice system, which provides this estimate, specifies that these investors paid Amadou KD or his companies $1,878,729 (a little over 1 billion CFA francs).
“Some allegedly dipped into their retirement accounts to participate in the projects. The prosecution maintains that the majority of these funds were used to finance personal expenses: rent for a residence, luxury vehicles, clothing, restaurants, gyms, spas, and online purchases,” Les Échos reports. Two examples of lavish spending highlighted by the prosecution: the purchase of a Rolls-Royce Ghost and a Ferrari 458 Spider, both used, for $133,778 and $177,185 respectively (75 million and 100 million CFA francs).
Two former ministers of Macky Sall who were spoiled
Furthermore, according to the US justice system, some of the funds were used to give gifts to government officials in foreign countries. This exposes the accused to the Foreign Corrupt Practices Act (FCPA), the US law aimed at combating bribery practices involving foreign public officials .
Two former ministers under Macky Sall are among the officials implicated, for actions dating back to 2018. Their identities have not been revealed. In the indictment, one is designated "Official 1," the other "Official 2."
During a trip to the United States, the first individual was able to travel by helicopter to attend a Lakers basketball game, thanks to funds provided by one of Amadou KD's companies, Virtual Advisors. His host also reportedly covered his accommodation, domestic transportation, and various entertainment activities, according to the DOJ.
“Official 2”, for his part, had invited Amadou KD to Senegal in December 2018. During this trip, the latter had promised to offer him five cars for a political campaign.
Les Échos reports that the prosecution alleges the benefactor offered or promised these gifts in order to obtain land. However, the newspaper notes, the American justice system does not specify whether the vehicles in question were allocated or whether the targeted land was obtained by Amadou KD. But regardless, the newspaper continues, "under American law, an offer or promise of benefit can be sufficient to support a charge based on the FCPA, if the prosecution demonstrates" the offense.
While awaiting the verdict in the case, the American justice system will rule on September 10th on a dispute between the Senegalese man's defense and the prosecution. Amadou KD's lawyers are brandishing the results of studies conducted by three expert firms, which analyzed the financial flows in question, to demonstrate that some of these transactions were legal. The prosecution is requesting that this request be dismissed, "arguing that these expert reports were submitted too late and that they do not comply with the rules allowing for verification of their reliability and for questioning the authors," concludes Les Échos.
