Litige foncier à Sud-Foire : La fondation Cheikh Abdoul Aziz Sy réclame son expulsion, Seynabou Ndiaye brandit 22 ans d’investissements
A land dispute between businesswoman Seynabou Ndiaye and the Cheikh Abdoul Aziz Sy Foundation was heard this Monday before the judge of summary proceedings at the Dakar High Court. The case concerns the eviction of the occupant and the demolition of buildings erected on a 1,000 m² plot of land in Sud-Foire. However, the case was adjourned until October 26, 2026.
At the end of the hearing, Youssoupha Camara, Seynabou Ndiaye's lawyer, challenged Cheikh Tidiane Diouf's standing to act, despite Diouf being presented as the foundation's representative. "If you don't have a mandate, you're not the owner, you're not the manager or director of the company. You need a power of attorney, and he doesn't have one," he argued.
The defense also requests that consideration be given to its client's investments, as she has occupied the plot since 2004. According to Mr. Camara, the constructions carried out on the site amount to between 60 and 70 million CFA francs. He also asserts that his client has been paying 50,000 CFA francs per month to the town hall since 2005, for a cumulative amount exceeding 25 million CFA francs.
The lawyer warns that compensation will be sought if the court rules in favor of the foundation. "We should be compensated for the constructions. It will be either the State of Senegal, the municipality, or the foundation," he stated.
A lease at the heart of the controversy
The dispute concerns lot 12 of land title TF 1677/NGA, located on the two lanes of Liberté 6, near the municipal emergency medical service (SAMU). The foundation claims a 30-year lease granted by the State in 2010, for an annual rent of 5,000 CFA francs.
Acquitted of charges for illegal occupation on January 19, 2024, Seynabou Ndiaye contests the land references and the conditions under which the lease is attached to land title 1677/NGA. The foundation had taken steps to correct what it presents as a clerical error before filing a civil lawsuit to obtain an eviction order and the demolition of the structures.
The defense is requesting, in particular, that the exact location of the plot and the relationship between land titles TF 1675/NGA and TF 1677/NGA be clarified.
