After contesting the results of the elections of the Senegalese Football Federation (FSF) before the FSF Appeals Commission, Mady Touré appealed to the Court of Arbitration for Sport (CAS).
Following the CAS ruling, both sides quickly claimed victory. However, a careful reading of the decision reveals that the case is far from over.
It is important to first reiterate a crucial point: Abdoulaye Fall is indeed the chosen candidate and remains, at this stage, the elected president of the FSF. The CAS decision does not make Mady Touré the new president of the Federation.
The CAS has accepted Mady Touré’s appeal on procedural grounds and has asked the FSF Appeals Commission to review the case.
This means that the CAS has not declared Mady Touré the winner of the elections, nor has it, at this stage, annulled the election results. It has referred the case back to the competent body for further review.
A procedure that can therefore continue
The FSF Appeals Commission will now have to issue a new decision following this review.
And if this new decision does not satisfy Mady Touré, he can, if the conditions and appeal procedures provided for by the applicable regulations allow, appeal again to the CAS. The dispute could therefore enter a new stage before the sports arbitration body.
That is why it is premature to speak today of a definitive victory for either side.
Can Mady Touré nevertheless speak of victory?
Yes, but this is primarily a procedural or principled victory.
His appeal led to a review of the case by the FSF Appeals Commission. This is an important result for his camp, but it does not mean that he has won the elections or that he has become president of the FSF.
For his part, Abdoulaye Fall remains the elected president, as long as no subsequent decision legally calls into question the results of the election.
In short, the CAS has made progress in Mady Touré's case, but has not yet definitively ruled on the electoral dispute.
The next step will be the new decision from the FSF Appeals Commission. Depending on this decision and the appeal procedures provided for in the regulations, the case could be brought before the CAS again.
Therefore, two things must be distinguished: Abdoulaye Fall is the elected official of the election, while Mady Touré has obtained a review of his challenge.
Both sides can therefore welcome certain elements of the CAS decision, but the legal battle is not yet over and the final outcome of the dispute remains to be determined.
